spouse settlement visa refused - appeal?

spouse settlement visa refused - appeal?

The wife has had her application for a spouse settlement visa refused.

Reason 1. "You have not provided any evidence of sponsor's immigration status in the UK..."
The sponsor (me!) is a UK National and this was stated on the application form, along with my UK passport number. However no documentary evidence was provided.

Reason 2. "You have not submitted ...a full 12 months' payslips as required"
I had lost some payslips but the payslips submitted more than covered the financial requirement.

Should I appeal or do I submit another application?

Please help.

The time it will take to to get a result from an appeal could possibly be the same (more than likely though, it may be longer) than it will take to make a new application. And, it won't be cheap to appeal either, so, I would just submit a new application!

For number 1, it would be prudent to get your passport certified, that will more than enough be sufficient proof.

For number 2, you admit you have lost some payslips, and, you are aware you need to submit 12 continuous months of payslips if you applied for category B. Keep in mind, with a fresh new application, you will need to submit new payslips!

Both points of refusals in lack of documents is correct. It is mandatory to submit your passport copy and mandatory to submit 12 months continuous payslips, regardless of whether what you submitted met the requirement.

The law requires the ECO to contact you if evidence are missing. Therefore the decision appears wrong in that respect.
