EEA marriage route for naturalization

Post by Qwerty123456789 » Fri Nov 04, 2016 2:42 pm

hello guys
i have read the article about good character ,but would like some clarification

I am not from EEU
came to the UK in august 2001 on student visa till december 2014

was living in the uk with overstayed visa

November 2009 got married with EEU citizen

December 2009 applied fro EEA 2

may 2010 received residence card

may 2014 received decree absolute

January 2015 retained my right to reside

January 2016 received my Permanent residence card (for 10 years)

my question is

when is the earliest i can apply for Naturalizaton ?
i thought that one year after i received my PR ,which is January 2017 ( i have passed my English and life in the UK exams summer 2016) but now read about "Good Character" .

Please advise.
Thanks

There is no "10 year" route for EEA permanent residence, it's 5 years which as you have stated, you have completed.

How did you have a student visa for 13 years?

The cards (not the status) are (or were) renewable every 10 years.

In that case it seems like you were in breach of immigration law until November 2009 when you married your EEA spouse.

As you are aware this attracts a 10 year ban from citizenship, starting from the date you become legal.

Based on that it seems the earliest you can apply is November 2019, assuming the rules don't change before then.

Like noajthan says above, your permanent residence status does not expire. You need to renew the card every 10 years (just like a driving licence).

I guess ,
need to wait 10 years before i can apply, so it is 2020 for me, probably need to go for the tests again , as their validation is 2 years.

Life in the UK test does not expire, so keep it safe.

The language requirements for naturalisation may well change before 2020 anyway.
