FLRO to FLRM plz help

HI to everyone

I really need your advice,

I,ve been living in this country since 2009 as student, I have done my Msc forensic 2012 and in between I went to india many times, Oct 2012 I applied further student visa from India to do MBA (2012-2014) I have done my MBA and before my actual visa was expired I made an application on Tier 2 in April 2014. after been waiting for home office decision I changed my mind and prefer to study PHD instead doing job and Sept 2014 I made FLRO application and explained home office why I want to study PHD instead of working. I got letter from office Jan 2015 and they asked which application they want me to proceed TIER2 or FLRO, by replying them to proceed FLRO I got refusal and they also given me right of APPEAL.

SO I've applied APPEAL and it took 1 year to get the hearing date, so JAN 2016 I went to court and explained everything and also submitted my PHD proposal and unis interview letters and other information but they asked me more information and told me to submitted before March 2016 and we did, July 2016, I got refusal and we put an application for permission to appeal to the Upper Tribunal and still waiting their decision.

so between in these process I got married and my husband has british nationality and he has good job and hes fulfilling all the requirements, when we went to registry office to get the dates I asked home office to send my Paspport photo copy and home office sent straight to the registry office and also said the 28 days notice will be apply on us.

we got married last week, so my question is now, can anyone pls advice me what is the next process?
am I eligible to apply for the spouse visa from UK Or shall I have to leave the country and will need to apply from home country?

please I really need your help and it would be really appreciated if you guys please advice which way is best ?

You will need to withdraw your appeal and apply for FLR(M)

Hey CR001
Thank you so much for the reply.

I've just called the home office and they said if you are on second appeal then you don't have any rights to apply within uk.! They said I have to withdraw the appeal and then leave the country as soon as possible and apply from India.

But I've talked with some Solicester and they said I can apply from uk.

I'm really confused, and I'm seeking if anybody have same case issue in past. But as you and Solicester are saying to withdraw the appeal and apply from uk and I can't understand why home office giving different information.

Is anybody has same iusses please reply.
