Extension Application without UK born dependents

Extension Application without UK born dependents

Hi,
I need immediate suggestion and advice as I am going to apply in Feb2017 and need to start maintenance.
I have 3 dependant kids who are born in UK,4,3 and 2 years old.I travelled last year and all have dependant visa till mine.
Now To apply for all together need a lot of money,I just read a thread where I understood that UK born kids do not need to apply until unless they need to travel and come back.I was aware of this fact but as they have applied once and travelled and have expiry stamped on passports.

1_Can I only apply for me and my wife now and then for my kids after application decision?
2-if I do so will there be any issue with kids stay or any query why they did not apply?
3-can there be a question about NHS health surcharge for them?

I need advice please as I need to go ahead with maintenance.

No you can't skip them as your Kids already have visa expiry they must apply with you

2-if I do so will there be any issue with kids stay or any query why they did not apply?
If you do , they will become overstayer and will affect their future applications, if you don't send their applications HO will write you to explain why you have not sent their application as they were being dependents on your initial application !

3-can there be a question about NHS health surcharge for them?
If you don't apply their application you don't have to pay NHS but this will create issue as in 1 & 2

Please Note Child born in the UK don't need visa until they are in the UK since birth and they don't need to travel but once you have successfully applied for their dependent visa the rules are same as dependents visa i.e apply for the extension before the expiry of their stay in the UK.


Alternatively If you can't afford to pay for them then you can send them back before their Visa expiry and apply for your extension only which once approved you can then again apply for their entry clearance when you have enough funds , but this seems to be difficult decision as you will have to stay here without family until your extension approved.

No, you MUST include them in your application as they all have been issued visa before, otherwise HO will object.
