Dependant out of Country : ILR

Post by jnikki4u » Tue Nov 22, 2016 6:09 pm

Hi,

I have got my ILR and I am now a British Citizen gained through 5 year Tier1 and I year ILR.

My dependant entered Uk later July 2012 so it is 5 year route for ILR.

What is the limit that a dependant can be out of country for securing ILR.
My partner might work on business visa or work permit in Middle East.

if he gets Business Visa well and good..

do you see any problems here ?

and As I am Britsh citizen now once he gets ILR immediately can he apply for BC as well under 3 year route ?

Regards
Nikki

ILR requires residence in the UK and absences should be limited and for good reason. Partner cannot apply for ILR outside the UK.

When did you partner APPLY for the initial visa in 2012??

BC yes, once ILR is granted partner can apply for BC immediately.

thanks CR001.

he is the limited company director and if he secures Business Visa it is fine i guess.

He applied Visa in August 2012 so he needs to wait for 5 years.

I mean he will apply for ILR in UK only...but want to knwi if he gets the residence permit of other country will it be a issue ?

so a tier1 Genral PBS Dependant once gets ILR can immediately apply for ILR if he is not more than 90 days out of UK.

Nikki

Thanks CR001. He wont stay for a year long..

He will be doing trips to Middle East on Business purposes only.

Correct I mean BC.

He came in March 2013 so he will be eligible only by Feb 2018..and once he gets ILR in Feb 18 ..He can apply for Citizenship in March 18 .
