ILR on fresh Tier 2 Applications from India

Hi All,

I am not able to find the correct topic where I can find information.

Is ILR still available for fresh accepted applications for Tier 2 General provided I spend 5 years as per ILR rules, as I Am planning to do so from India.

I have already spent close to 6 years in UK and was refused on ILR in May 2016.

If you apply for Tier 2 General, after your 12 month cooling off period, you will qualify for ILR after 5 years on Tier 2 General, provided you meet the requirements, whatever they are at that stage.

another Q, Can I count my last leave as Tier 2 ICT whilst I was in the UK? to add 5 year towards ILR, however there will be a cooling off of 1 year which may break continuous residence while calculating 5 year towards ILR.

No, you cannot count the time spent in the UK on ICT as you applied after the rules changed in 2010, which is exactly why your ILR was already refused.

You will need a new 5 year residence period to qualify for ILR.

That aside, absence of more than 6 months breaks continuity of residence anyway.
