FLR m extension Refused

Post by JustSamsung » Tue Nov 29, 2016 1:45 am

Hi!

My wife initial visa was due to expire end of August 2016, I applied for her extension, I am earning 18K a year and with overtime it gets bumped up, however due to a car crash my wages for 12 months prior showed 18,500, on this basis her visa was rejected however I was given right to appeal which I logged straight away; my questions are as followed

Will the appeal let me give new evidence which will show that I am earning over threshold?

Also, what is waiting time for appeal because me and the wife need a holiday but she can't enter the country once she has left? I lodged appeal in September.

Thanks in advance for your help.

Does your wife works .

Appeal take months or slightly over a year these days.

You ought to have found something to cover the 100£ shortfall.

Yes I have done that, I just want to know will they accept new evidence in my appeal? Like for example latest pay slips?

So appeal really takes a year?

So if my wife was to leave the country would she not be allowed to enter?.. this is shambles if you are awaiting appeal

Yes, an appeal can take a year or more.

Your wife won't be permitted to re-enter the UK without a valid visa.

Won Lower Tier tribunal

Post by JustSamsung » Sat Oct 07, 2017 12:55 pm

Hi,

I posted a year ago for some advice on appeal dates for FLR(m) after 12 months we had our appeal and 4 weeks later we found out that the appeal has been accepted by the judge.

We are now in the 14 days where the home office can appeal the decision..

What my question is what next?
How soon can my mrs get her visa?
Does her flr(m) start from when previous one expired or when the judge made his decision?
Biometric cards were not available when we first applied, do they take long to make as we are looking to go away on holiday after all the stress?

Thank you

From the date HO issues the visa.

You could still be waiting a couple of months before getting anything. Once visa is granted, the BRP card is sent by DX Courier within a couple of weeks. Suggest don't make any plans until you have the BRP card.
