Tier 4 Visa - Appeal won. Now what?

Post by Vineetha » Tue Nov 29, 2016 10:39 am

Hi,

I successfully finished mt Master degree in the year 2011.

I applied for level 7 Strategic management and leadership skills course and this was rejected in 2013 (Reason: Not UKBA approved bank statement) I went for appeal I won appeal and I got 60 days letter in 2014 Nov.

I couldn't take admission in University as September intake admission date was already passed. According to my solicitors advice we again requested 60 days this was rejected by UKBA and we went for oral hearing on 2nd of November 2016.
We won the appeal. Judge approved it straight away.

1. Now how long I have to wait for UKBA to issue letter?
2. Do they send 60 days letter or 60 days stamp on passport?
3. I would like to get Ph.D admission in University. Will this be possible when I get 60 days letter?
4. My solicitor said we can request UKBA to issue 60 days stamp on passport, this would let me go to home country and apply for Ph.D and if I comeback to UK within next 6 months and all my previous years in UK will be calculated for PR.
On the otherhand if we get 60 days letter - if I go home country to make new application and the previous years won't be counted to make 10 years.

I am not sure if this is my solicitor trying to get more money from me to send letter to UKBA.

Please advise.

Regards
Vineeta

Surprising that solicitor has not mentioned UKBA was abolished in 2013.
And if on UK domestic migration route PR is not an option - its ILR.

You need to ask your solicitor these questions. That's what you are paying them for!

My solicitor not responding properly. He always says he is with client call after 10 minutes, but he never pick my call.

He charged me 1000 pounds every single time he requested letter to Home office.

I don't even know if am allowed to work fulltime. He said I have full right because I was on PSW when I applied for TIER 4. Work status doesnt change until I get new visa.

I am very much worried about all these details. I don't know what to do.

First thing to do is find a decent advisor (via Law Society or OISC websites).
Or a community law centre or migrant advice centre.
Or else rely on your innate intelligence, organisational skills/attention to detail - and this forum.

If relying on this forum, I strongly advise you only follow advice that quotes specific rules or guidance, which you can then double-check for yourself.

Indeed.
In fact triple-check. Bearing in mind that the map is not the territory.

After all who would listen to some random chap on the proverbial number nine omnibus - and that is, in one sense, all anyone is doing here, except that the forum is a very big 'omnibus' with 100,000+ members making up its enormous and redoubtable hive mind.

And do you have a reference for that (did you see what I did  )

Hi

I just checked now on Law Society.
This solicitor is on the list. Does that mean all the information he provided is right?

Looking forward to hearing from you.

No ofcourse it does not.
Or he may be partially right some of the time - as well as being expensive.

But if he is talking in terms of "UKBA" and "PR" he's way off the mark.

Not necessarily. It means you have an an avenue to report them if you have a complaint on the level of service you have been provided with.

Here's an official link to the procedure:

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Ok. Thanks.

Meanwhile should I approach a new solicitor? If so, where can I get genuine solicitor details from.

You can try a migrant or community or student law centre as alternative. Check you uni law school.
Or look for recommendations from co-students and friends/acquaintances.
