Getting divorce what is the situation?

Getting divorce what is the situation?

07/10/2002 Came to UK with student visa.
14/7/2004 Got married to a EU citizen in London.
26/7/2004 went to the EU country origin of wife and stayed there for 9 month then back to his counrty of origin to get entry clearance and get back in UK.
1/5/2005 Entry clearance was valid for 1 year then applied for spouse visa.
Spouse visa valid till 26 june 2008.
11th may 2006 criminal offence(conviction charge) theft/going equipped. The court imposed a community order for 50 hours and £60 charge.

Just wondering if he can stay in uk if they get divorce or he has to go back to his own country. Many thanks

Is the person under discussion you or someone else?

What nationality is that person? And which EU state is the wife from?

No its for a friend of mine. He is asian and his wife is EU citizen. Does it matter which nationality real? Please advise thanks
