Hi

I am eligible for ILR in March 2017.My baby is born in UK.I am planning to apply for my country passport from UK now. will this impact or matter while applying MN1 registration for my baby in March 2017.I need to apply for passport for baby now since I need to travel to my country with Baby due to personal emergency.

Elaborating on CR001's post, a child born in the UK does not need a visa as long as it stays in the UK. However, if such a child leaves the UK, it will require a visa to reenter just like any other person.

If the plan is for the MN1 process to be commenced while the child is in India (after March 2017), be aware that the registration process can take up to six months, followed by a further six months to a year for a British passport overseas. And once the child is issued with a registration certificate, s/he is not eligible to apply for a visa to return (British citizens can not be issued a visa to return to the UK). So, there is a chance that you will not see the child for about a year or more.

Thank you very much for the details. :)

I will apply for Baby's visa from my home country and will get it 21 days .Planning to be back in UK in end of Jan2017.After coming back to UK will apply for ILR followed by MN1 Registration for my child.


So I understand having any visa before applying for MN1 will not have any impact on MN1 registration provided child is born in UK and either of the parents had ILR.
