HELP!! EEA (PR) Application for spouse of a British citizen

Post by CrisPaix » Fri Dec 09, 2016 5:56 pm

I am an EEA national married to a British Citizen. I've lived in the UK for 10 years now and am being told I should apply for a Permanent Residence Card or I can be asked to leave after Brexit.
I am very worried about this, I am 62 years old and I never worked in the UK, I married my British husband and we have never had to live on benefits thankfully. I have always paid my own health insurance.
However, my husband (68 yrs old) had a stroke two years ago and I am his carer, I get carer's allowance for this reason.
Can my husband be my sponsor in my application?
Will I be considered to have been exercising my treaty rights even though I have always been a housewife?
Please can anyone help me?
Thank you for taking the time to read this.

Your husband cannot be your sponsor in the UK as he is British.

You mention you have always had private health insurance - this may qualify you as self sufficient. Have a look at that route.

Thank you I'll read through the guidance. At least now I have a starting point!

It's a longshot but if you are in effect a full-time carer for hubby, and hubby is in in receipt of carer's allowance, DLA etc then there may be a case made for you for derivative EU rights.

It is a complex area. Further advice will be needed.
See https://www.gov.uk/derivative-right-residence/overview

The Aire Centre have done sterling work in this area and may be able to advise (or even represent) you.
