ILR for child lives more than 7years in UK

Post by Umyousra » Sat Dec 17, 2016 7:06 pm

Dear all, I came with my family to UK under Tier 4 student visa in Sept 2009. At that time I have one son who was 3 years Old. We stayed under this visa till July 2014 when we switched to Tier2 General visa. Our visa is valid till Nov 2019. We will be eligible to apply for ILR in July 2019. I have two daughters who were born in the UK. I have the following questions:
1. Can we apply now for ILR as family with a child who lives for more than 7 years?
2. If we wait till 2019 to apply for ILR, do we need to apply for my son too?
3. Can I apply for my son alone now and the rest of us can wait for 2019?

Regards

By no means a guaranteed route. See the thread in the following link:

1. Can we apply now for ILR as family with a child who lives for more than 7 years?
No. It is not ILR but FLR(FP) which is difficult to get and a 10 year route to ILR. Years of abuse of the 7 year concession has made this a very difficult route, even more so because you actually have a visa that does lead to ILR itself.
2. If we wait till 2019 to apply for ILR, do we need to apply for my son too?
Yes, children born abroad are expected to hold ILR to qualify for British citizenship.
3. Can I apply for my son alone now and the rest of us can wait for 2019?
No, unlikely as he has a valid visa that DOES already lead to ILR.

There is no shortcut or quick route. Strongly suggest you stick to the route you are on.
