Accommodatio requirement Changing to Spouse Visa

My wife has been in the UK for over 20 months. She arrived in UK on Dependent visa. Last year, my immigration status changed to ILR. I am in the process of switching my wife's visa from Dependent to Spouse (FLR M).

We are living in a house shared with another family. We have the whole ground floor which consists of 1 Bedroom, 1 Reception room, own bathroom with shared Spam.

The owner of the house has tenancy agreement with the family living upstairs. Owner of the property is not living in the same house. The ground floor was rented to me by the tenancy agreement holder. We have been living in the house for over a year and do not have any tenancy agreement. I pay my rent to the family living with us.

In short, a portion of the house is sublet by the person who is the main tenant who pays the rent to the owner of the house.

I would like to know what documents do i need in order to fulfill accommodation requirements.

Does the owner know that the tenants are sub-letting? :?:

You will need a written agreement from the owner as the landlord agreeing to you and your wife living in the property. The other tenants aren't your landlord.

Are you aware that switching to FLR(M) will reset your wife's immigration clock to zero, putting her on a new 5 year path to settlement? Under what terms did you qualify for ILR? After 5 years or a 10 year long residence route?

I dont know if owner knows about the sublet.

Yes i am aware that my wife will have to wait for another 5 years.

I was granted ILR on 10 years long residency route.

OK, you've confirmed FLR(M) is the correct application.

However, if the tenants are sub-letting the accommodation without the knowledge of the landlord you have a problem as they are unable to give permission for you and your wife to live in the property. I strongly suggest that you check this out.

Your wife will also have to submit documented evidence of your joint residence. Do you have bills/correspondence in both of your names at this address?
