**URGENT HELP** dependent visa for brother in UK

Post by joblessgamer » Sat Dec 24, 2016 3:28 pm

Hi. I came to uk in 2015 in masters course and I was getting a work permit from a company but due to some difficulties, company wont be able to issue me tier 2 and my visa is expiring in 5 months. I need to know if there is any option I can consider? I have my brother in uk who got british passport based on his tier 2 basis. He paid my uni fee (i was doing part time job while studying). anyone knows if i can figure out something?

There is no route under the UK immigration rules that you can remain or apply to remain in the UK based on your brother.

Adult dependent relative visa is impossible to get. The link below explains how difficult this visa is to get and as you appear to be young but over 18, you would not qualify for this visa.

Find another Tier 2 Sponsor.

What is your nationality and how old are you?

So Tier 5 youth mobility is not possible either and I assume that you have no UK born grandparent either.

You could look at doing a PhD otherwise you will need to find a Tier 2 sponsor or look at Tier 1 Entrepreneur if you have substantial funds to invest in a business.

Your brother could look into moving himself and his whole immediate family to another EU state and sponsor you that way using the Surinder Singh route, but with Brexit and HO clamping down on this route recently, not sure how successful it will be.

But under the UK immigration rules, there is no route open to you based on your brother being British.

Extended family members, such as brothers, are not eligible under the Surinder Singh route anymore.

See Regulation 9(4)(b).

Your brother is unable to sponsor you under either UK or EU law. You will have to do it on your own under either the Tier 2 route or the Tier 4 route or the spousal route.
