Marriage Visitor visa

Hi All,

With regard to the Marriage Visitor visa, so I've previously been refused an extension for Tier 2 work visa (10 Nov, 2016) on basis of the new Minimum salary requirement for Experienced workers. (My new job offered £27,000 but UKBA minimum for experienced workers is £31,100). For this reason, I had to leave the country as my current visa then had 2 days to expire. I am currently out of the UK.

Now I intend marrying my Fiancee who I've know for over 3 years. I want to apply for the Marriage Visitor visa so I can come in and get married but I am concerned of the chances of this being rejected seeing as I previously " applied for leave to enter or remain in the UK in another category and been refused." . This is one of the reasons listed in 3.2 Factors which may be associated with a relationship which is not genuine and subsisting

Is this something to worry about? Do I really need to prove our existing relationship at this stage (Marriage Visitor visa)

NB: We have previously talked about marriage even before my visa extension was refused. So this is not just because I need a way to re-enter as an alternative to the tier2 visa.

Let's be clear here. A marriage visitor visa is for someone who wishes to marry in the UK (within 6 months), but intends to leave after the wedding.

Is this your intention? If not, you need to apply for a fiance visa.

Yes this is my intention to come in and get married then leave after the marriage. Then apply (from outside UK) for the "family of a settled person" visa.

Then why not apply for a fiance visa, which is 6 months validity and then you can remain in the UK and apply for FLR(M) once married??

HO might still scrutinise your application and relationship given your recent refusal.

Yes true, but we currently dont meet the Financial requirement stated in the Fiance visa, so we just wanna do things one step at a time. Plus the cost of the Fiance visa is a lot more for which we are not prepared for that yet.
