Standard 6 months Visa Refusal for Uzbekistan Citizen

Post by GARBUZ20 » Thu Jan 05, 2017 4:48 pm

I am Uk citizen and my wife is form Uzbekistan and we both live in the UK. We applied for Standard 6 months visa for my mother in law from Uzbekistan and provided all relevant sponsor letters. The visa was refused and the explanation was given that all sponsorship documents are accepted but there is a concern with regard to what the applicant (mother in law) is doing in Uzbekistan and the source of her savings (we indicated that she saved $700 for one week trip to London and the rest is paid by us).

When we apply again what minimum income do we need to show for my mother in law to be eligible? Also what minimum amount of money on the bank account do they need to see? What is the money is given by us as gift via western union?

Thank you

There is no real minimum amount. M-i-L must prove her financial circumstances, i.e. if she saved, where did the money come from (work, gift, rental, etc) with documentary evidence etc.

The onus is on the applicant to provide the personal and financial ties to their home country regardless of who is sponsoring their visit. They have to convince the ECO that they are genuine visitors and will leave the UK and return to their home country.

How long did she state she was going to visit the UK for?

Appreciate our reply. She stated that she is coming for one week and she has $700 for it. She took a document from the bank confirming this. the money was gifted to her by us. Do we need to reapply and state that this $700 was gifted to her by us, and in addition to this show that she is making small property rental income as well as owns her own property and is married?

From your reply i understand that there is no minimum income threshold she needs to hit in order to apply. So if her property rental income yields her $50 per months it should be presented in her application even though the amount is small?

You may say that as a moderator with a fair level of understanding of the visa requirements, applying for a family visitor visa should be simple.

Not so unfortunately. My mother-in-law applied for a visitor visa to spend 3 weeks with us before Christmas. She submitted documented evidence of property ownership, family ties with a husband, 5 adult sons & daughters, 6 grandchildren and €7,000 euros held in a savings account for several years. My husband submitted financial evidence to sponsor her visit.

Refused as no proof of where the savings originated, and no employment in her home country. It's becoming increasingly difficult to succeed in a visitor visa application, especially as the route to settlement for adult dependent relatives has been virtually closed.

I could be entirely wrong, but it seems to me from recent posts that showing that the applicant has close family in the UK counts against them quite significantly, especially if the UK family sponsors the applicant (which indicates a level of dependency). However, if you don't disclose that, future applications could be refused for deception. You can't win.

What proof that your mother-in-law will return home before the end of her visa did you attach?

Hi,

Yes probably the problem is that we did not attach any proof that she has ties to her home country other than mention of her husband in the cover letter.
