I am planning to apply for ILR this year I need some basic question answered it will be very helpful I am currently on work visa in UK since 2013 (tire 2 G)
1) Could you please let me know if by Nov 2017 I will complete my 5 years for ILR as I got my first work Visa issue on 13-12-2012 Valid till 23-11-2014 the current one from 05-12-2014 to 04-12-2017 as I am planning to apply mid Nov 2017 - You can apply within 28 days before reaching the 5 years. You say you have been in the UK since 2013. On what date did you arrive in the UK?
2) What is the time period for ILR (as I see the application are done for 5, 10 & 14 years) is there a fee difference for the Time period. What do you mean by time period?? The 5, 10 & 14 (14 no longer available though) is the number of years residence required to apply.
3) The salary stipulation of 35,000 should it be met at the time of application or prior to that, how do I show that I am getting the 35,000 a letter from my employer with payslip & bank statement (if payslip & bank statement for 35,000 what is period required to be shown) currently I am getting paid according to the SOC code which can be proved by bank statement and payslip. One payslip is sufficient. It is slightly more than £35k though from April 2017.
4) I did my MBA in UK do I still need to do a Life in UK test. LIUK test is a separate requirement to the English test. Your degree meets the English requirement. You will have to write the LIUK test though, you are not exempt.
5) What is the validly period for the Life in UK test. It doesn't expire.
6) IF applying for ILR do I need to show any maintenance Not sure but I don't think so.
7) My wife visa (dependent) is also expiring at the same time but she joined me in July of 2013 so I am not sure if she is eligible for ILR if she is not then, under which visa application I can apply for her extension visa. I read at a random website that I need to apply FLR (M) for my wife but I am not sure and did not find any fee mentioned for the same No she is not eligible for ILR. She needs 5 years residence from the date she ENTERED the UK. She can apply for a Tier 2 dependent extension. She DOES NOT have to switch to FLR(M), which would reset her clock to zero and a new 5 year residence period.
8 How Long is FLR (M) for Not applicable as she can apply for PBS extension. FLR(M) would be 2 x 2.5 year visas though.
9) Is there any NHS fee (Health Surcharge) for ILR and if there is any for FLR (M) No, not for ILR but for your wife's extension yes.
10) Do I need to show any maintenance for FLR (M) Not applicable as she can extend her current visa.
11) Does my wife also need to do a Life in UK test if she is not applying for ILR and is only applying for the FLR (M) No
12) Once she has applied for FLR (M) can she directly apply for citizenship ( if I get it before her) or she needs to get ILR first No. She needs ILR before she can apply for citizenship. She needs 5 years residence to apply for ILR. If you change her visa to FLR(M), she will only qualify for ILR in 2022.
Then you can apply within 28 days before 13 December this year.1) You can apply within 28 days before reaching the 5 years. You say you have been in the UK since 2013. On what date did you arrive in the UK? – Actually I am in UK since 2009 first as student the 2 years on PSW when I got the work visa I was in UK issued on 13-12-2012
ILR is indefinite, provided you DO NOT live outside the UK for two or more years (short visits do not maintain ILR status). The BRP card however will be valid till 2024 and the CARD must be renewed (like a drivers license).2) What do you mean by time period?? The 5, 10 & 14 (14 no longer available though) is the number of years residence required to apply. The Length of ILR is for (e.g.:- my work visa is for 3 years)
Sorry, yes it is April 2018.3) One payslip is sufficient. It is slightly more than £35k though from April 2017. I thought it was increasing after April 2018 are you sure it’s after April 2017
Tier 2 Dependent is an online form only. She can apply on the same day as you. You will need two separate appointments, hers a couple of hours after yours.4) No she is not eligible for ILR. She needs 5 years residence from the date she ENTERED the UK. She can apply for a Tier 2 dependent extension. She DOES NOT have to switch to FLR (M), which would reset her clock to zero and a new 5 year residence period. – How do I extend her visa on tire 2 as I will be applying for ILR on the same time, is it possible to extend her visa on tire 2 dependent with me not being on tire 2
If you apply for ILR based on Tier 2 with 5 years residence, the rules permit your dependent to remain and extend their tier 2 dependent visa, see link below. The extension will be a 3 year extension.1) if i am applying for ILR and as advised if my wife's is extending her visa on tire 2 dependent would her application not be invalid as i am not anymore on tire 2
