I went on premium service yesterday to vary my application from Tier 1 Entrepreneur Extension (applied in Nov,2016) to ILR LR. On my way to there I got a phone call saying that there is a fire evacuation and your appointment has been cancelled and we can reschedule you for next week. While she was doing that I mentioned that I wanted to vary my application as my previous application is in pending. She was bit confused then told me you cannot vary at premium because your leave has expired last month. You can post it but not vary. I mentioned that according to HO guideline I can vary at anytime until my decision is in pending but at the end she didnt reschedule me and gave me email address to ask for refund.
Also at the end manager came as well and explain we \i cannot come to premium and can only ppost it. When I mention HO guideline he said he is not disputing guideline but this is what we know that your leave expired and you cant vary at premium. He also has recorded in system thou
Now I dont understand what should I do I am in just very difficult position
Kindly advise me if someone go through same scenario or knows what o do?
