tier 2 Licence Revoked

Hi All,

Need advice on my case ASAP.

I entered in UK on 6 jan 2012. and work for company as tier 2 (General )

my due date was on 3 dec 2016 for applying ILR.

But company who sponsored me there licence revoked on 22 Nov 2016.

I have been told by my company to leave uk before 22 JAN 2017.

Is there any possiblilites i can apply for my ILR even my company Licence revoked. ?

Awaiting reply ASAP.

Have you received a curtailment letter form HO telling you to leave by 22nd January or is the company telling you this?

A mandatory requirement for ILR from Tier 2 G is a letter from your employer stating your salary, position, start date etc and stating that 'you are required in your position for the foreseeable future'

HI,

I havent received any letter from HO. But my company said this to me.

so if i get letter from my company i can apply for ILR even there licence revoked ? is that correct.

Also once i get ILR i will not need any sponsor and i can work for same company.

early response will be much appreciated.

The company has no licence to sponsor any tier 2 now amd the required letter , even if provided by the company, will be invalid..my 2 cents..
You need to be required by a company with a valid licence..

ILR will be based on no. of year and tax you paid to government.

i did both so any possibility with my ILR.

No, not if you are not with a licensed sponsor and do not have the required letter from your employer even if you have completed the required residence. These are mandatory requirements for ILR specific to the category of visa you hold.

Paying tax is an obligation every person has (British, EU or foreigner), it does not give you any additional rights as a migrant.

HI all,

I left Uk on 29 dec 2016.

on 3rd jan 2017 my HR informed me that company Licence is revoked now.

Now i am looking to travel back on 10 jan 2017 to uk to find new sponsor.

question is if there any possibility that challenge me while clearing UK border ? if so what i need to do to clear immigration.

I have letter from Home office saying i have 60 day to find new sponsor from date of curtailment letter.

Although non of employee received any letter from Home office to leave UK.

You may have a problem re-entering on your current visa.

"That is correct, the sponsored employees can work in the role in which they were sponsored until the date their leave is curtailed. That is usually 60 days from the date on the curtailment letter"

and my comapny HR also happy to give support.

If immegration officer chaellenge me what should i answer ?

Were you asked any questions on reentry? Because if you were asked the infamous, "Have your circumstances changed?" question that is often asked of Tier 2 holders and you answered 'no'. You might have some problems later on.

I'm not surprised they let you reenter without any problems because let's look at this with common sense. You have not broken any laws and are a respectable wage earning person who still holds a valid visa for UK.

Plus a person with many years of life in UK will potentially own property and personal belongings etc. and require to wrap up their affairs here before leaving for good within curtailment timeframe. So I don't see how and why they can stop you from reentering to either find a new sponsor or close off all affairs most of which would require face to face interaction e.g. closing bank accounts.
