Child Registration

I am settled in the uk. I have one child who born in th uk before I was settled.

One of my friend from Poland had a little baby of 6 months. After receiving permanent residence in the uk, She straight applied for uk passport without applying for registration for child and she received the passport today.

My questions are
1 Is there any change in the rules for child registration
2 Can I also apply for child passport when I am settled in uk and not from EU country without child registration
2 Is the child registration rule different for EU citizens

Any help will be well appreciated.

Your friend must have been settled with PR status before her child's birth.
The date of receiving a confirmatory PR card is irrelevant - it was friend's settled status that was significant.

How are you settled - with ILR or with PR status?

1) Since when?

2) Only if you (/one) parent was settled before child's birth.
if you were settled afterwards then you have to register child.

If your friend had only acquired PR after that child's birth it would have been same for her too.

3) No. There is not an EU flavour of citizenship.

1 Is there any change in the rules for child registration No, there has been no rule change. If child born before you got ILR, the child must register as BC on form MN1.

2 Can I also apply for child passport when I am settled in uk and not from EU country without child registration No, your child is not British, so cannot apply directly for a passport

3 Is the child registration rule different for EU citizens No, same rules regardless of nationality of parents.

Date of PR card is not the date of when an EU citizen 'automatically attained PR'. If your friend was in the UK working for 10 years for example, PR was 'automatically attained' in after 5 years.

Thank you for prompt reply. In the mean time I was also able to access passport office letter that they wrote to my friend asking for more information.

It is written in this letter that parents of EU only need to show that they have been excercising their treaty right for last 5 years so send us the proof of work( PR is not important). The child only need to claim British Nationality so (child registration is not necessary).

I am surprised after reading all this. Nothing is relevant to me as I am not citizen of EU.

I really appreciate your help in this matter and clearing all the ambiguity. Thanks a lot.

Proof of treaty rights being exercised continuously for 5 years IS proof of acquiring PR :!:

What you refer to as "PR" (and as something as being "not important") is merely the optional and confirmatory DCPR - or 'PR card'.
