Tier 2 (G) refusal due to wrong CoS number

Post by daas__ » Mon Jan 16, 2017 10:12 pm

Hello,

Thank you all in advance for all your responses.
My latest application to extend my leave to remain in the UK has been refused due to an expired Certificate of Sponsorship reference number. I or my employer were not aware that the reference number had an expiry date. In this application, I added the same reference number as the one I had used in my past application 3 years ago. This is a mistake on my side and my employer side.
The refusal letter states that I can apply for administrative review. My employer has now issued me a new CoS number.
My existing visa expired 1 month ago while my application was being processed. I am currently in the UK.
I am between choices as to what I should do next. Should I apply for admin review and include the new CoS number or should I make a new application within the 28 days window?

Cheers

Admin Review is for situations where HO has made an error. They have not made an error in your case so AR will be pointless. Submitting AR with a new CoS is also irrelevant. A CoS is only for a visa application not a review of HO's decision, which was correct at the time of decision,
or should I make a new application within the 28 days window?
You don't have 28 days. This has recently been reduced to 14 days. When did you receive the refusal?

Thank you CR001 for your response.
I received the refusal letter on 14th January and it has been posted on the 12th. I presume it is 14 days from the 12th, right?
My passport and other documents have not been sent back to me yet and not sure when it will be posted back.
I am not sure I can make a new application within the 14 days window.
What are my options if I don't apply for the admin review and wait for my passport to be posted to me? Can I make a new application while my visa has already expired?

Thanks again.

Apply immediately using the new COS.
You will not get your passport back so don't wait for that. They don't return passports if you don't have valid leave remaining.

Thanks, Frontier Mole.
I will go with the option of making a new application. My employer is still waiting for the approval of the new CoS and they have paid for the priority service to make sure we get it as soon as possible. It might still take up to 5 days and I will make a new application as soon as I receive the new code. Do you have any idea how many days I might have to make a new application?

You only have 14 days after refusal.
