"Enclose a letter from"

Post by AliZawa » Thu Jan 19, 2017 12:13 pm

Hello Guys.

1. Should I for the proof of sponsors employment include both points mentioned. because my company filled in the 12.A and 12.B with the signature in the 12.B

I kind of cannot ask my company to include another letter with the same information they signed for. Is it something I have to go through or the part they did till now is more than enough?

========================================================================
Section 12: Sponsor is currently working
Proof of your sponsor’s employment
 Ask your sponsor’s employer to complete the declaration in section 12B, or
 Enclose a letter from your sponsor’s employer confirming the details in section 12A. This must be signed and dated by the employer, include the employer’s contact details, and be on the letter-headed paper of the employer.

2. My wife is from morocco and I am German prof. worker in UK. she is already in UK and got the 6 month period which will end tomorrow the 20th Jan:

2.a) will that have an impact on the procedure that the period ends tomorrow?
2.b) if they somehow refuse this time. Am I still allowed to reapply another time while my wife is in the UK
2.c) is my wife allowed to stay in the UK even the period will finish tomorrow

Thanks guys if you respond today will be perfect as I am willing to send the documentation today as I got the last proof of living together yesterday

Cheers

Ali

Welcome.

This post moved to correct forum: EEA.

I assume your wife is in UK on a 6 month FP (expiring imminently) and you are now applying for the optional RC using form EEA (FM).

1) As well as employer's declaration you need to provide evidence as per section 20 of EEA FM form.

2a) No

2b) Yes

2c) Your wife is more than welcome as long as you are a qualified person in UK.
The RC is optional and merely confirmatory (although useful).

Thank you VERY VERY much.
you said:

but in this section it s written:

Proof of employment (sections 8, 9, 10, 12, 13, 17) – e.g. employer’s declaration (section 12B) or letter, plus wage slips or bank statements showing receipt of wages.

Am I missing something here.

Sorry for posting in the wrong forum.

As a rule take a belt and braces approach and provide multiple forms of documentary supporting evidence.
That way, if one document is not up to scratch for some reason then you have already provided an alternative.
After all why give HO the wriggle room to refuse you.

The FM guidance clarifies the position. You need payslips, tax documents & etc to support the letter/declaration.
Employment
Evidence that your sponsor has been working for 5 years, such as wage slips, employer’s letters, P60s, etc
– see guidance for sections 12 and 13.
