Spouse visa extension question - need help

Spouse visa extension

Hi All,

I will be applying for my wife's spouse visa extension in April 2017 as her Spouse/dependent visa is about to expire in second of May 2017.

I want to prepare and ensure correct document and information is provided within the application to be successful and for the same reason, I need help

My visa was granted Spouse/dependent visa in Aug 2014 when I was holding Indefinite leave to remain and now I am British Citizen.

As per my understanding, we have to fill in and provide FLR (M) form for the extension of visa, meet financial requirement which is £18,600 and fulfil English language requirement.

I would like to know if we need to fill in any other form apart from FLR (M) and in order to meet financial requirement provide 8 months salary pay slips and use previous IELTS report even though it has now expired but was provided with the visa application spouse/dependent visa.

I would appreciate if anyone advice me on the above mentioned query, as this will help and guide me in right direction.

Hi All,

My wife who is on Spouse/dependant visa is planning to apply for her visa extension in April as her current leave to remain will expire on 11 May 2017 and we have few questions with regards to English language requirement and evidence to prove that we have been living together.

As a part of her initial application in 2014 she submitted IELTS - Academic Test report (Overall band 6.5) the test was taken in October 2012; I would like to know whether she can use and provide the same IELTS test report for her Spouse visa extension and whether her IELTS Test complies with required A2 level or not.

With regards to evidence to prove that we have been living how many pieces of document should we need to provide in order to prove it to Visa officer that our relationship is genuine and we have been living together for past 2 and half year.

Just to inform that in terms of documents, she has her bank statement ( 2 different account), name on water and council tax bill, her and my name on my son's birth certificate.

I am little bit confused and would appreciate if you please help and answer above given queries.

In regards to your question of using an expired IELTS certificate, here's an excerpt from page 11 from the official HO document:

"Under paragraph 32D of Appendix FM-SE if an applicant under the partner or parent routes
submits an English language test certificate or result and the Home Office has already
accepted it as part of a successful previous partner or parent application (but not where the
application was refused, even if on grounds other than the English language requirement), the
decision-maker may accept that certificate or result as valid if it is:
(a) from a provider which is no longer approved, or
(b) from a provider who remains approved but the test the applicant has taken with that
provider is no longer approved, or
(c) from a test centre which is no longer approved, or
(d) past its validity date (if a validity date is required under Appendix O),
provided that when the subsequent application is made:
(i) the applicant has had continuous leave (disregarding any period of overstaying of no
more than 28 days) as a partner or parent since the Home Office accepted the test certificate
as valid; and
(ii) the award to the app"

So, the answer to your question is, yes, you can use it!

I have read Pg 65 and 66 of FLR M 'Six items of correspondence addressed to you and your partner at the same address as evidence that you have been living together since your last grant of leave in this category'

We do have following documents which are addressed on the same address,I am not sure whether it meets six items of documents and if not, please suggest what should we do now in this regards as we only have two months at the moments before current spouse/dependant visa expires

To main thing to bear in mind is that you are required, for the same address "six items of correspondence" or "twelve items (six each) of correspondence" if you do not have enough in joint names.
And of course, to put the "six items of correspondence" or "twelve items (six each) of correspondence" in proper context, you are also told below, on page 65, note 11 that
"The dates of the items of correspondence should be spread evenly over the whole period you
are relying on. They should be from at least 3 different sources."

The key thing to distinguish here is "items", "correspondence" and "3 different sources".

So, in your case, you can do the following; use council tax, water bill as joint and bank statements for both of you. I say this because it says on note 11 the following
"Four items of correspondence in joint names to the same address and two items
addressed to each partner at the address. In total eight items would need to be submitted."

Now, four items of correspondence in joint names, this just means, you use 2 letters sent to you from each of the joint sources, the council tax and water bill covering the entire 2 year period. This is because 2 letters will be 2 items, but since you are using 2*2, this is 4 items covered in joint names. Now, for the bank statements, you do the same, 2 separate each covering the entire 2 year period. That, in total, gives 8 items and 3 different sources used, thus, meeting the criteria.

Now, to cover the entire 2 year period, you have to space them out "evenly" as you are told. To do that, you just do the following, for council tax, have it start from wherever you want from 2014, for example September and October(2 items) and then the water bill, have each of those 4 months apart from September and October and then same for the bank statements, because, this way you cover the entire year of each and every year (4*3).

I hope this makes sense!

Hi MobeenSaeed,
Great advice there. I am bit confused with the document required myself. Does all the piece of correspondence have to cover the entire 2 years or are they seeking for differnt source of documents to patch up the time the couple have spent together.
Looking back we have

-bank statements (two differnt banks but we hold multiple accounts).
-letter from GP (Mine are more upto 2017, as my partner is pregnant she has more recent ones).
-Driving Licence from DVLA (both of us do have full licence, in demcember 2017 we recently bought a car in my name).
-TV licence I had been paying till January of 2018, but now I have trasnfered that to my partners name.
-Gas and electricity in my name till Jan 2018 but have now moved that to my partners name.
-Letter from DWP as I am receiving PIP and ESA.
-Water bill under my name.


I own the propoerty with my mother and most of the bills are under her name. Can the letter from employer employer who works few hours serve as a proof of correspondence?
