Switch from Tier 2 ICT Short term to Tier 2 General

Post by shobithk » Fri Feb 03, 2017 12:33 pm

Hi,

Would like to explore possibilities. Can you please help me out if below is possible within UK. Or what are the possibilities if i go out of Uk an apply.

My current VISA - Tier 2 ICT Short Term VISA. Start June 2016 ending June 2017 (1year)

I Would like to switch to

1) Tier 2 General (From another sponsor)
OR
2) Tier 2 ICT Long Term Established staff (From same sponsor)

Also, if i am eligible for any of the above, what are the possibilities for applying for ILR after 4 years.

Thanks.

Cos sponsorship for Tier 2 General

Post by shobithk » Fri Feb 03, 2017 12:40 pm

i have to apply for Tier 2 General from outside UK, as i cant switch my Tier 2 ICT visa because of restirctionls. But the cooling period applies as a result. What are the implications for my employer to generate a Cos for salary for more that 155000GBP for Tier 2 General VISA. Basically if we want to get rid of the cooling period terms. I am working for his company as an umbrella method. Will he be liable for more taxes? Will he be liable for any other charges?

1) Tier 2 General (From another sponsor)
You will be subject to the 12 month cooling off period for this option.
2) Tier 2 ICT Long Term Established staff (From same sponsor)
Possible. Still does not lead to ILR though.

I am working for his company as an umbrella method.
This is not permitted and is illegal on Tier 2 General.

Working under an umbrella is illegal.

Who's going to pay you £155,000 anyway? Income tax alone would be nearly £60k unless this is some sort of fiddle which it looks like it is.

I really hope for your sake that you have not been working for your employer on an ICT visa as an umbrella company!!
