Hi please can somebody give me some advise. My friend has indefinite leave and would like to apply for her British Nationality. She was granted spouse visa 30th november 2008 visas granted for 2 years and 4 months. Visa finished february 2011.Arrested by border agency on 26th April 2012. Released on 5th May 2012. Three month period for indefinite leave 31st may to 30th August.Indefinite leave was made permanent 19/09/2012.card valid till 30/08/2022. Case on domestic violence. Please can you tell me when she can apply for her British Nationality. Any help would be greatly appreciated.

If there's a British spouse then asap after ILR grant.

Otherwise, 12 months after ILR granted.

The period between Feb 2011 and 19 September 2012 will count against her as she was an overstayer based on what you have posted.

She will likely qualify for citizenship in 2022.

thankyou for the replies but now im lost i thought she could apply as soon as she has her ILR. but now ive been told she cant apply till 2022. which one is correct pls

What was her immigration status between February 2011 when the visa expired and September 2012?

Any period of overstaying with no valid visa means she will fail to meet the good character requirement for citizenship.

sorry for the late reply. Her immigration status was 4th February 2011 till 31st May 2012 she was an overstayer. She then had a three month temporary admission which was given by the home office. On the 20th August the ILR was applied for which was granted on 19th September 2012. Please can you state whether she can apply for her nationality now or she has to wait till 2022. Many thanks
