Calculate 28 Days to book ILR Appointment

Hello Members,

I want to calculate my earliest date (28 days before 5 years) to apply / book for ILR;

Visa : Tier 2
01/05/2012 - 15/01/2015 - 1st Visa grant
23/01/2015 - 19/01/2018 - Extension

On the basis of above dates could I book appointment for ILR on 03/04/2017 or earliest would be 04/04/2017?


2nd Question:

Extension is granted on 23/01/2015 and 1st visa expiry is on 15/01/2015 , does it make any difference to calculate 5 years although I applied my extension before my visa expiry?


3rd Question:

Do I need a absences letter from employer although i was away only for 4 weeks in last 5 years and it was due to my family matters?

No, that period is covered by section 3C and counted in your 5 year legal stay

Yes you should provide evidence for ALL your absences.
However if the absences are less than (30 days + public holidays) per year and inline with your annual statuary paid leave, then the case worker is allowed to grant you ILR without a letter.

My wife also have same visa dates, could she apply for ILR with me as well, although she came in UK September 2011 but became Tier2 visa dependent from 01/05/2012?


if you don't mind could you please elaborate more following, I was away from UK 3 weeks in 2013 and 2 weeks in 2015, all these days were part of my annual leaves (24 leaves / year), still do i need letter and what contents should it have (just give abstraction).

Hi gurus;

I go through guideline and draw following table based on given example (but following dates are according to my scenario).

I want to apply on 04 April 2017 and initially Tier 2 visa was granted on 01/05/2012;

Year 1 04 April 2017 To 05 April 2016
Year 2 04 April 2016 To 05 April 2015
Year 3 04 April 2015 To 05 April 2014
Year 4 04 April 2014 To 05 April 2013
Year 5 04 April 2013 To 05 April 2012

on this basis am I eligible to apply by post /book appointment on 04 April 2017???? Really appreciate your reply.

Following is the guideline details;

Page 19:

Calculating the specified continuous period

Applicants can submit a settlement application up to 28 days before they would reach the
end of the specified period. However, the specified continuous period is always counted
backwards from the date the ILR application is submitted. For example, if an applicant would
have reached the end of a specified 5 years with leave in a qualifying route on 30 November
2015 and they apply on 11 November 2015, the consecutive periods would be as follows:

Year 1 11 November 2015 to 12 November 2014
Year 2 11 November 2014 to 12 November 2013
Year 3 11 November 2013 to 12 November 2012
Year 4 11 November 2012 to 12 November 2011
Year 5 11 November 2011 to 12 November 2010


The applicant may not have had leave in a qualifying route for up to 28 days at the start of
Year 5 (in this example, between 11 November 2010 and 29 November 2010). This is
acceptable.
