Tier2 PBS dependent Wife’s IHS shows 1400 and ILR Husband

I'm new to this forum!

Currently My husband is applying for ILR from Tier 2 general 5 year route.
I entered UK with Tier 2 dependent visa on 28th Nov 2015 and my visa valid until 16th Feb 2018.

My question is which application form I need to use as a ILR dependent?

You have a choice of either switching to FLR(M), times 2, followed by SET(M) or remaining as a PBS dependant and extending once in 2018 shorty before leave expires, followed by SET(O).

Thanks for your quick reply.

I am currently in UK as Tier -2 general Dependant visa which expires on Feb 16th 2018. I am only 15 Month in UK until today.
And My husband currently in ILR through PBS Tier 2(General) from feb 2017.

Please advise on which visa do I have to extend my stay (PBS Tier 2 Dependent Visa or FLR (M)) ?

I called Visa help-line they told me that I can stay on Tier 2 and can apply for extension under Tier-2 once it expires in 2018 feb 16th.

So , I'm confused PBS dependent or FLR -M ??

Any help is greatly appreciated. Please can anybody advice me?

You can continue on your current visa till you meet the 5 year residence requirement for ILR.

If you switch to FLR(M), your clock will reset to zero and you will be on a new 5 year route (2 X 2.5 year visas) before you will qualify for ILR.

I'm thinking to stay in pbs depedent visa instead of switching to FLR-M.but
My husband planning to apply for british citizenship by next year, am I still eligible to stay in uk with PBS Dependent visa?

If so which visa application form I need to choose to renew my extension ?

It will make no difference, you can still continue as a PBS dependent until you qualify for ILR.

Dependants of PBS (Tier 1 General, Tier 2) migrants
Spouse / Partner
1. The dependant is subject to qualifying residential period to be eligible for settlement. For the duration of qualifying residential period and associated conditions that may apply, see Note below.

2. If the dependant has completed the relevant qualifying residential period at a time that the principal migrant applies for settlement and meets the other requirements then the dependant may be included in the principal migrant's settlement application.

3. If the dependant has not completed the qualified qualifying residential period at the time that the principal PBS migrant applies for settlement, then:

a) If the PBS dependant's current leave will expire after he/she has completed the qualifying period and the dependant meets the other requirements for settlement then the dependant may apply for settlement directly (319E).

b) If the PBS dependant's current leave will expire before he/she completes the qualifying period then the dependant can apply , before his/her current leave expires, to extend his/her PBS dependant leave until such time that he/she becomes eligible for settlement (319C and 319D). Though switching to FLR(M) leave is also an option but anyone switching to FLR(M) on or after 06-Aprl-14 will have his/her ILR clock reset, i.e. - time spent in UK as PBS dependant will not count towards qualifying residential period for settlement.

Currently I'm on pbs dependent visa and my husband has ILR my visa expires on Feb 2018 so my question is during this Period can I travel to India my home country or any other countries???


If in case of travel and when returning back to U.K. Is there any kind of immigration problem??

The dependent of the T1-ENT (PBS) has no travel limitations at all. If he/she is outside the UK for more than 180/d yr may affect ILR

OP is on Tier 2 General Dependent not Tier 1 Ent. Also, it is not only Tier 1 Ent that is the PBS route category (Tier 1, Tier 2, Tier 4 & Tier 5 all PBS).

Same absence rule applies though to all categories of PBS dependents.

In the online application the IHS payment shows £1400 please can you suggest how can I pay for just next 3 years which is £600.
