Changes to salary threshold on April 2017

Post by thilina098 » Wed Mar 01, 2017 10:45 am

I am a software engineer currently on Tier 2 Sponsor visa and I have seen the new visa rule changes on April 2017. According to new rule changes, I know that the new entrance salary threshold won't be affected for all the NQF levels and all the experienced salary thresholds will be £30,000pa if they are lower than the new threshold. But currently it's £31,100pa for experienced Software Engineers (SOC 2136) and I wonder if anybody knows if there are any changes for this threshold?

Also feel free to correct me if I'm wrong.

According to the @iworker, salary threshold is such a confusing issue right now. I read on the NSH tier 2 Employer website they have clearly mentioned it that it will only affect those who got their visa on or after 24th of November. But still not sure about that.

[Ref]
Do the new higher salary thresholds apply to those individuals currently on a Tier 2 visa?
No, the new minimum salary threshold applies only to those making an application under Tier 2 (General) for the first time from 24 November 2016. Applications for Tier 2 (General) extensions or to change employer for those already in Tier 2 before this date will not be subject to the new salary threshold.

This is confusing me now.
Isn't that increased salary threshold also for those who are already in a Tier 2 (General) VISA before 2016?

Hi ozayh.malik,
One of the guy just posted this latest Codes of pratice.
https://www.gov.uk/guidance/immigration ... illed-work

My code is 2137. On that latest code of pratice document, I can see that the experined rate is : £23,400.

So I asked others and also mentionmed about this sattement:
The Home Office has announced that the minimum salary of £25,000 will rise to
£30,000 in April 2017. There will be no transitional arrangements for applicants granted between 24
November 2016 and April 2017 - applicants who were required to meet the current minimum salary
of £25,000, will be required to meet the higher rate if they submit a Tier 2 application after April
2017.

They told me that I should be earning £25,000 or more if I apply before april. And £30,000 iof I apply in/after April.

So I am bit confused? :?

What should be my experienced salary for TIER 2 (general)extention?

help please!!!

kind regards
kumar

Hi ozayh.malik,

I am in some what of similar siatuation as kumar but i am applying for ilr in may under tier 2 5 year continuous route (june 2012 - may 2017 applying 27 days before) , i am in phd role job with appropriate rate as mentioned in appendix j whic is below 30,000 .do i still need to meet this 30,000 threshold for ilr. I am clearly exempt from 35,000 threshold for settlement as i fall under phd exemption category. Please provide any information if you have.

Thanks
