Definition of a 'New Business'

Definition of a 'New Business'

A business will only be considered to be a “new” business for the purposes of Tables 5 and 6 if it was established no earlier than 12 months before the start of a period throughout which the applicant has had continuous leave as a Tier 1(Entrepreneur) Migrant, and which includes the applicant’s last grant of leave.

Where does this leave me with following circumstances:

Company Incorporated - 10 July 2012
Initial Applied for Tier 1 (ENT) - 2 August 2012
Refused - 7 June 2013
FTT - 15 Nov 2013
FTT Refusal - 16 Dec 2013
Applied to FTT for permission to appeal in UT - 23 Dec 2013
Permission Refused - 16 Jan 2014

Reapplied Fresh - 25 Jan 2014
Tier 1(ENT) Issued - 21 March 2014

So my new business seems to be NOT NEW anymore? :roll:

The table 5 is for applicants applying for extension and this is what it says and so does the guidance under extension table

The applicant has:

(a) established a new business or businesses that has or have created the equivalent of at least two new full time jobs for persons settled in the UK, or

(b) taken over or invested in an existing business or businesses and his services or investment have resulted in a net increase in the employment provided by the business or businesses for persons settled in the UK by creating the equivalent of at least two new full time jobs.

Just trying to understand that if I am still under the former category or latter?

You started a NEW business with respect to job creation criteria as you have not taken over or invested in an existing business :!:
