Hi
Please if any members can give me some information.
I am a non eu citizen living in ireland with my eu citizen girlfriend.
We are living together from last 2 years we have 1 kid together which is also eu citizen not irish.
Now my question is i want to apply as a de facto partner but the question is in my mind that she was previously married to non eu citizen who got stamp 4 because of marriage .now they got divorced recently.
Will be this problem for me to get resident permit.

Hi

It should be taken as a fresh application according to the extensive reading i did.

You need to to ensure that she did a perfect cut off with previous relationship.

Did previous marriage last more than 3 years ?

Is the Person still in the state? (if yes hopeffully he's no more on EU4FAM visa but a different one like retention !!)

Did she Update Eu treaty right with change of circumstances (breakdown in the relations and divorce) on time ?

The marriage lasted more than 3 years but the court proceedings were started when the marriage was in 3rd year.
We dont know any immigration status of her ex.
She didn't informed eu treaty section about change of her relationship.
We thought she is not bound to tell the eu treaty section.
She can write to them now if that will help?

Sorry i am online rarely but that's difficult what if he's still in state and abused the visa rights ??


Should be ok marriage last 3 years before divorce and he left the state after divorce or he legally obtain a right to stay in Ireland that's all i can see from documents.


At this point i am unable to provide more ideas.

If it was me i will try to get in touch with ex to find out if he left Ireland or not .
If he left after divorce that's Good.

But if he didn't leave :?: , if she can't contact him either well a lawyer is your best friend there as it's not very clear here.
