Please Help - Tier 2

Post by chson7 » Tue Mar 14, 2017 11:33 pm

Hi Guys, need help seriously asap.
My dates and history are as follow

Entered into UK as tie-4 student dependent in Dec-2009
Started working for a company on 4th Jan-10
Got first Tier-2 General COS on 15/08/2011 - same employer as above
Work start dates: 16/08/2010 for 2 years
Visa applied 16/11/2010 - postal application
got approval letter on 13/10/2011 with visa valid till 29/08/2013
Got 2nd Tier-2 General COS - extension on 01/08/2013 for 3 years
Visa applied on 02/08/2013 - postal application
Got approval on 28/08/2013 - visa valid till 29/08/2016

Here not sure whether I was eligible for ILR - based on tier-2 route - 5 years - working for same employer.

My employer was under impression that he has a tier-2 COS to issue to me for 3rd extension but when in he looked at his SMS he found there is no COS available on 1/8/2016 as it was withdrawn on 6/4/16 as at start of year it was not used. So he request COS for me on 2/8/16 but it was rejected saying he applied as per old COS -
Now panic button pressed....he reapplied for COS for me on 16/08/2016 - he got message that it will take about 3-13 weeks for him to get new COS.
I thought I am eligible for ILR and decided to apply as on last date before expiry of current visa on 29/08/2016 using SET O.
Applied for ILR on 25/08/2016
HO received Documents on 26/08/2016 -
Now on 27/08/2016 my employer got confirmation that COS request is approved and he can assign COS now. but being Bank holiday etc he didn't take any action and issued me COS on 30/08/2016 for 2 years with work start date 30/08/2016
I was advised to withdraw my ILR application by company solicitor which I did on 31/08/2016 and requested to return my original documents.
On 02/09/2016 I cancelled my withdrawal application and instead requested them to divert documents to new application.
Applied for tier 2 extension on 02/09/2016 - Vary leave
Got email from HO on 07/09/2016 saying they have my 2 applications which one I would like to pursue, I confirmed to withdraw of ILR and requested refund. Got refund of Tier -2 fees. they kept higher fees.
since then no response from HO....waiting waiting till date.
On 16/01/2017 I wrote a letter requesting an update.
My legal representative also sent a letter on 15th Feb -17
Finally received letter from HO on 27/02/2017 informing they are doing what they can do to process my application and no time frame given - only letter from HO. They said alternatively I have an option to withdraw my application and return to my home country.

really scared of HO after paying such high fees , after 28 weeks still there is no reply.

Can any senior member advise on my case, where what went wrong and what could be the problem.

ps. all criteria matched - RLMT done when 1st COS assigned, salary well over required nearly double the requirement.
Can anyone please help

If you met the requirements for ILR why did you not continue with that application?

Sorry for posting in wrong topic, CR0

Well for not continuing mr ILR application , as per my employer I was short of few days for ILR so he asked me to apply for tier 2 extension.
If you can please look at my dates in earlier post and see was I eligible for ILR?
And what could be the problem and why so much delay
Thanks
