10 year route confusion (please help)

10 year route confusion (please help)

I have a question and confused about it as i cant see clear answer anywhere hope people here can help me out, my question is that i came to uk in 2006 on student visa on 2011 caught working more than permitted hours, went to court and got decision in favour on article 8 family life as i had british fiance and got 6 months temporary visa to get married and after that applied for spouse visa which was refused by home office than went to tribunal and got decision in favour and issued 2.5 years spouse visa which is due to extend end of this year for further 2.5 years, i have two questions now please

1. i am under new or old rules ? regarding 18500 per year financial requirements.

2. can i still apply for 10 year route or is it break?

i will be thankful if i get response especially from gurus here, thank you guys in advance. :D

When did you apply for spouse visa and what was the start date?

thanks for your response, applied before the new rules introduced but was refused by the home office than it went to tribunal and won in the tribunal.

Why were you given 2.5 years then. They either should have given you 3 years or 2 years under the Old rule.

no idea why, its for total of 30 months issued in 2015 after a long court battle started from 2013, now what could be the best way forward? can i still ask home to change it as its suppose to be before the rule changes, and 10 year route is it still valid for me? thank you

If it started 2013 then it is current rule.

When was original application made.

i have made the application before the new rules in feb 2012 which was refused by ukba end of 2012/2013 start, than i went to the tribunal and won the case than home challenged it again than went to tribunal 2 and i won it again in 2015 and visa was issued in 2015 mid, my brp does not says what type of visa is it, its says only LEAVE TO REMAIN thank you

What ground was your appeal allowed under. and did you have leave to remain before your application was lodged?

in 2011 i won the case on basis of article 8 family life and was given 6 month leave to get married and can apply for further leave that was the court judgement, than in 2012 before the new rules i have applied for the flrm, and my last appeal was allowed on same article 8 family life as home office refused flrm mainly on that i can go back get married and apply from my original country and few points about not enough proofs of genuineness relationship etc which was quite funny as we submitted about 700 to 1000 pages of proofs :D

They should have given you a first set of 3 years and then a second set of 3 years and after 6 years you apply for ILR.

so what can i do now? so you saying that i am in under new rule? why can you please explain? as i have applied before the new rules and what you say about 10 year route is it still there or break? sorry for too many question :D i just wanted to clear my head thank you
