Falling short on Employment Creation

Post by nish_patel7 » Tue Mar 21, 2017 6:09 pm

Hi All,

I am on Entrepreneur visa 50K route, applied on Dec 2012. My extension is due on 16th July 17. I have two employees working for my company. But I am falling short of 5 months of employment creation as 1st employee started working from September 2016 and 2nd employee started working from October 2016. My question is can I recruit 2 more staff for coming 4 months and make up my shortfall on employment creation? Or is it that the minimum the employee need to be in the business for 6 months to claim the points? And also is it true that the maximum you can claim 130 working hours for full time employee? Your comments on this will be much appreciated. Thanks

How did you apply in 2012 but got the initial visa by 2014 ???
You simply need total of 24 months of full-time employment if you are covered by transnational arrangements

Hi Zimba thanks for ur prompt reply, my initials visa was refused and after going through the appeal process I eventually got the visa in July 2014. Home office sent me my visa in November 2014 only then I came to know that I have got the visa but my visa was effectively started in July 2014.

If you have created 24 months of employment, then you should be fine

Thanks Zimba, just to be sure, so if I recruit 2 staff from April 2017 to June 2017(3 Months) will it be counted as 6 months employment? And I already have 19 Months. So the total I can claim is 25 months am I correct?

Be aware of genuine entrepreneur test. Just hiring for a few months for making the 'min quota' will (and should) raise eyebrows so make sure it all makes business logic. cheers
