Partnership visa submitted

Post by Charleenable » Sun Apr 02, 2017 6:30 pm

Hi

My husband and I have submitted a partner application and we are waiting to hear.

Unfortunately I didn't meet the financial requirements by the tiniest amount (about £6) due to an oversight. :(

We submitted the application through a reputable solicitor so all other requirements were met.

As I did not meet the income needed, we later submitted a supporting letter from my employer stating that some overtime I worked before the time of application was not included in my payslip which is why I did not fulfill requirements.

Just wondering if anyone has been in this situation and can predict what result we can expect?

Thanks

If it is not on the payslip or evidenced in the bank statement, you risk facing a refusal, even for £6. The rules are very clear on the financial requirement and the Supreme Court has upheld the limit set by HO.

Many people who have applied are receiving emails stating their applications are on hold following the court judgment.

Applying through a solicitor has no effect on your application at all.

It was a company error as they did not include overtime I worked on my payslip. However it was evidenced in my bank statement and payslip that I submitted the following month.

When I said that I applied through a solicitor, I meant that they checked the documents thoroughly, not that it would give me an advantage.

If it was very clearly explained by your employer, UKVI might use discretion.
