URGENT: Tier2 G to FLR to Tier2 G - counted in 5 years ILR?

Post by JaneMurphy » Thu Mar 30, 2017 8:00 pm

Hi,

My Tier 2 General visa will expire on 27th May 2017 (3 years visa) and current employer license got suspended which am sure I do not have further extension here. There is a new company would like to hire me but they have to apply for sponsorship license (preparing documents). It seems timeline is very tight and some one suggested me to apply for FLR (Further Leave to Remain) to buy some time. In this circumstances, could you please help below queries:

1. Am I qualified to apply for FLR in this situation?
2. If I transfer FLR to new Tier 2 General, is still counted for ILR (5 years Tier 2 G visa)?

Your immediate response would be highly appreciated. Thank you!

1. Am I qualified to apply for FLR in this situation?
No not really. HO is very wise to this ruse of 'buying time' and these frivolous applications (also grounds for future refusals) are refused fairly quickly.
2. If I transfer FLR to new Tier 2 General, is still counted for ILR (5 years Tier 2 G visa)?

No. You need a full 5 years on Tier 2 General to qualify for ILR.

Asking for 'immediate response' is a bit cheeky given that all advice here is for free in our own time and you post around dinner time/homework time etc.

Can any one explain here one solicitor said they can apply for FLR (IR) for another 3-6 months in which situation am legally staying here and get more time to look for job. The reason is my company license got suspended that is not my fault.

Is it a possible way? Or any risk? Thanks for your response.

FLR(LR) is only for those who have completed 10 years of legal residence but don't meet the KOLL requirement.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

FLR (IR) -- means immigration rules

Not sure if anyone have heard about it? For my case, one solicitor said I can apply this visa as license suspended is not my fault and HO will consider to give me more time to look for new job if I notice them in advance.

Please anyone advise? Thanks.

Tier 2 Extension under license suspended

Post by JaneMurphy » Wed Apr 05, 2017 8:11 am

Hi,

My Tier 2 G visa will expire on 27th May 1017 but my current employer license got suspended. Current Employer have submitted all documents for HO review and waiting for final decision. I have valid COS and prepare to submit my extension application. I understand my application will put on hold until my current employer's final decision come out. Could anyone help with:

1. If my employer license got revoke decision comes before 27th May 2017, Do I still have 60 days or do i have to leave before 27th May?

2. If my employer license got revoke decision comes after 27th May 2017, How many days I can be granted?

Appreciate your help, thanks.
