PBS dependent extension as spouse of an new ILR

Can my wife and baby apply BC once I become BC from ILR

Hi guys,

My situation is that I got my ILR last month based on my 5-year working under Tier 2 visa (Oct 2016) and I am planning to become BC next year (https://www.gov.uk/becoming-a-british-c ... -can-apply). My wife has been living with me in the UK since March 2014 and has been on Spouse visa. I was wondering if I get my citizenship in Oct 2017, by then, my wife would have been living with me for more than 3 years and she would then be considered as married with a BC. If I am correct, would that allow her to apply the citizenship straightaway?

Second question, our baby boy was born in Dec 2014 in the UK, will he be able to apply at the same time as my wife for the citizenship?

Last question, I have been working in a University in London and was told about a Childcare support scheme, it appears that I am eligible for that. However, I was wondering if I applied, will that affect my BC application next year since it is a type of public fund.

Wife needs ILR first. Then she may apply to naturalise after having resided in UK for 3 years. Section 6(2) BNA.

Child may register as a citizen asap; no need to wait for mom. Section 1(3) BNA.

Those on ILR may avail of state benefits if entitled; no impact on naturalisation.

Child can be registered as a British citizen now (as you have ILR).

Wife needs ILR, which takes a minimum of five years, before British citizenship. After ILR, she can apply immediately for British citizenship as the spouse of a British citizen, provided she meets the absence and other requirements.

List of Public Funds that "No recourse to Public Funds" applies to. Applying for funds not listed here has no impact on naturalisation.

So for my wife, she has to get ILR first in March 2018 (5 years living in the UK) and then apply BC in 2019 (1 year after ILR)?

For my son, I can register him now as a citizen using the form MN1 (at the bottom of this link https://www.gov.uk/becoming-a-british-c ... -can-apply)?

If you have become a British citizen, she can apply for naturalisation immediately after getting ILR in March 2018. No need to wait for a year.

Hi guys,

My situation is that I got my ILR in Oct 2016 based on my 5-year working under Tier 2 (General). Now my wife's PBS dependent is going to expire this month. Many thanks to Moderator CR001's suggestion (british-citizenship/can-my-wife-and-bab ... l#p1425747) that I can just simply extend her PBS dependent visa, rather than applying the FLR (M).

Now I have one more question: when I am filling the online form of PBS dependent, although I selected "Yes" to the question: "Do I have indefinite leave to remain or British citizenship?", It still asked me "What is the length of my CoS". Should I give the detail of my last CoS, the one just before I got ILR? Many thanks.

I have been getting so much of help from this forum, really appreciated and highly recommended.
