Parents Dependent VISA

Hi,


I am originally from India and currently got British Passport and was based in the UK from Nov 2006 to Nov 2015.

Due to my mother health condition and to take care of my parents (who are physically handicap – 100% blind) have moved back from UK to India. My mother is 65 years of age and my father is 72 , they both have visited UK for short duration less than 6 months at a time.

Due to my current family situation and primary reason for which I am not able to stay and work in the UK, it will be good for me to move back to UK and take care of them in the UK.

I need below mentioned advice.

• Can I apply for parents depended VISA and what are the chances of getting positive result.
• Can they access NHS, as due to their current health condition it will require Doctor’s assessment.
• What all documents will be required.
• Minimum waiting period before we can get result.
• Appeal if result is not negative.

Only 6% of ADR applications succeed on the first attempt. A further 16% succeed on appeal. That still means that 78% of all ADR applications fail.

I think these statistics are for applications that were made and appealed before July 2012. I think I have maybe only read of one member who had success after this date.

They are the post 2012 figures.

I crunched the numbers in the Home office ADR review. Mind you, the data only ran from 2012 to 2015, so not entirely up-to-date, but it gives a flavour of the success rate after the 2012 changes.

Thanks for your reply and help.

I feel there is no other option for me other than applying for the VISA. As without job it is very difficult for me to manage any thing and I also got property in the UK to pay its mortgage is impossible for me.

I got one query, if by luck application gets approved, are they eligible to use NHS free of cost please ?

In order to have free access to the NHS they will each have to pay the IHS Surcharge of £1,100 in addition to the visa fees of £3,250 each.

You are also required to support them financially during their first 5 years of residence and they will have no rights to claim Public funds.

Also bear in mind that if the ADR visa is refused this will close the door for any UK visitor visas in the future.

if my parents can get dependent VISA then we plan to move all back to UK. Please let me know any good solicitor who is confident to pick up my case and documents required for the same.

Can anyone advice please, is it any other alternative, as even if I apply for long term VISA, still they can only stay max 6 months with me (Is it true)

An Adult Dependent Visa application has become virtually impossible since the Immigration Rules were tightened in July 2012, with only a few successes and these only after an expensive and lengthy appeal through the Courts.

Do BOTH of your parents require daily care for basic tasks such as bathing, dressing, preparing food etc., AND that care is either not available in their home country or is not affordable?

Do they have other family members living in India?

Be aware that if you apply and are refused, the door to entering the UK on a visitor visa in the future will be closed due to the prior intention to settle. :idea:

As visitors your parents will be unable to spend more time in the UK in a 12 month rolling period than they are spending in their home country, even with a long-term visitor visa.

They are 100% blind, so they require help to do daily activities, my elder brother stays in same area but due to his work commitments he has to commute frequently outside the state / country for business trip.

Hence it is always helpful to have a family member around, but if dependent visa is rejected then they cannot come for visitor as well that will be big issue.

Was wondering on basis of handicap and reason of no one around to take care of them, on that basis are there any chances to get them permanent visas.
