Partner visa help - 2 x failed asylum

Partner visa help - 2 x failed asylum

is there something you can apply for after you have been in the uk for 10 years, as my partner has been here for 10 years as asylum seeker hes applyed twice and both times refused. he cant work and living on hand outs, we been togther 2 years now but im scared to build a life with him as i worrying he could be sent home or we could be just applying applying for along time thanks

There is no easy route. He won't qualify for an unmarried partner visa within the UK.

Do you live together??

FLR(FP) would likely not work either as you are not married and I assume you do not have children.

He really is not on any easy road even if he does qualify or get a visa. Besides the visa costs and immigration health surcharge fees, he would be on a 4 x 2.5 year visas (10 years) IF he can get a visa.

no we have no children and dont live together as i cant support the both of us, we are engaged but i have plans to marry as ive said before im scared ive been with him 2 years and i really do love him but wondering whats going to happen as heres been here 10 years and still no change.

Unmarried partner not possible then as this requires evidence of 2 years living together.

Not so easy to marry either. You are required to give 28 days notice to an HO approved Registry Office. They are then obliged to notify HO of the intent to marry and this notice period can be increased to 70 days for HO to investigate and / or interview each of you separately (to establish if it is a marriage of convenience to obtain leave to remain in the UK - yes this happens A LOT). You will then only be able to marry IF the Home Office gives permission for it. Your partner does risk being detained at interview. He also needs his passport to give notice to marry.

All of this still does not guarantee he can get valid leave to remain WITHIN the UK. As spouse of a British citizen (assuming you are British), YOU have to earn a minimum of £18,600pa and prove adequate accommodation for a spouse visa.

thanks no we have no plans to marry anyways i want to get married once hes sorted no rush for this as we both love each other and just want a life and children together, no i dont make that a year as a single mum of one boy and part time work i make no where near that, i just sees hes lows as its hard as he cant work and no option to go back home as he is from iran and at risk just looking for options thanks for your help :D

What were the reasons his 2 asylum claims were refused??

What basis or reasons did he submit asylum claims on?

How did he enter the UK and what date?

What dates did he claim asylym?

he came here as he had a disgrement with hes goverment so hes life wasnt save as he didnt agree with them
he came here feb 2007 and claimed ayslum 2007

When was first asylum claim refused?

And the second time, when did he apply and on what basis?

Are you not able to answer all my questions or not willing to answer them??

The basic truthful answer is that he should return home. He cannot get a visa based on what you have described and 2 failed asylum applications means HO don't believe him.

I can answer your questions there's nothing to hide, he has no evidence he came here 2007 tries to claim asylum 2010 then again 2013
