what my options

I come uk in Feb 16. I have wife, i have leave her and small daughter. i have no contact with them. we no register our marriage. i also not on birth cerafcate what way i can get further leave to remain?

You may need to apply to the court for child arrangement order.

Why was your name not on the birth certificate? Where you married at the time of the child''s birth?

Obie at present the OP says he has no contact with the child and isn't named on the child's birth certificate. I assume that when he mentions that the marriage isn't registered that this was a religious marriage which isn't recognised under British law.

Without a Court order for access I can't see that an application as the parent of a child resident in the UK would succeed as he has been taking no part in the child's care & upbringing.

Or the OP could be using the child/situation merely to gain LTR.

Or another plausible explanation could be, he entered in February 2016 with a Spousal visa, and a manipulative wife, is seeking to use the child as a weapon against OP, which is not a rear occurance.

@rizwanq123 which category of visa do you currently hold and when will it expire?

Since leaving your wife (I assume while she was pregnant or soon after as you're not on the birth certificate), have you been making any child support payments :?:

stupid mistake of mine - i refuse to come to registertation - we were not registered as married but married bcoz i come from pakistan on spouse visa

OK you should have gone. But your wife could still have put your name on it if she went with your marriage certificate.

There is no requirement for you to register your marriage in the UK if you were legally married in your own country (or where you were resident).

I'll ask again...have you been contributing financially for the care of your child :?:

i am on initial spouse visa - wife british citizenship. i want to sty with sister but wife not agreeing so i levae her. i no pay her. we hav joint account but i stop payments.

What your wife did is unlawful. If she told the registra that she was married to the father, then your name would have been entered even in your absence.

It is likely she told them that she is not matriage, which begs the question why?

You must apply for re-registration. However this usually happen if the child father and mother married after birth of child. FTom what you are saying, it seems the marriage took place before the birth.

The fact that you were not married in the UK is not a good reason for your name not being added.

This is your child, for goodness sake, you ought to have gone there for the registration.

you mis understand. me nt being on registration paper is my fault. wife call n call me. afterwards we got ok again -and i find out from my brother in law who also went to registrayion, he say that registr asked if parents married. wife explained we got married in pak but never registerd marriage in uk. so registar refuse to pt my name on it until im not there so wife had no choice
