Post Tier1 extension approval query

Post by Meesha » Thu May 04, 2017 1:04 pm

Dear Forum members,
Finally I got my approval letter today. Thanks a lot to every member who contributed to make my journey less painful especially to Zimba who has been hugely generous and kind to all people

My timeline is as
Applied 22nd December2016 with 4 dependents
Gave biometrics on 13 Jan 2017.
Received complex case letter early Feb 2017
My husband successfully varied his application to ILR in early March
Applied for my 3 kids British citizenship 30 Mar 2017
Received approval letters for all of us today, issued on 28th April. We all five are issued visas

Now i have few questions to ask

1: How HO can issue same person two resident permits like they issued to my husband? Should i call them or write a letter and return new residence permit?
2: Should i expect my husband fee returned for TIER1 Ent dependent application as his ILR has approved a long time ago? DO i need to write a letter for this?
3: I have received no health surcharge refund. Neither partial nor full. Can i claim for my kids and husband full health surcharge refund?
4: Should i return my kids resident permits too as their registration application is already under process or keep them until they receive their British passports?
5: Can my kids travel on these visas even if their British registration application is under process?

Thanks a lot
Cheers

How did he vary his application? In person and did he request the variation with a letter?
2: Should i expect my husband fee returned for TIER1 Ent dependent application as his ILR has approved a long time ago? DO i need to write a letter for this?
Yes, you probably should based on what you answer to #1 above.
3: I have received no health surcharge refund. Neither partial nor full. Can i claim for my kids and husband full health surcharge refund?
Why for your kids?? They were issued a visa as per the application submitted. You choosing to apply for BC is your choice and is a completely separate set of rules and laws. You can ask, but you might not get it for them as they have been issued a visa as requested. Are the kids all UK born??
4: Should i return my kids resident permits too as their registration application is already under process or keep them until they receive their British passports?
They are not British until you receive the citizenship certificate. Try and be a bit patient.
5: Can my kids travel on these visas even if their British registration application is under process?
They have a valid visa and assuming you have their passports, why do you believe there will be a problem travelling?

Hi CR001,
1: My husband used premium service and clearly states that he is varying his application in cover letter and got approval same day.
2. All are British born. As kids will get British passport, they should not pay for 2nd year health surcharge, i have noticed if people change/vary their visa category, their health surcharge for previous application left over years is refunded. Is it right?

Cheers

Query then with HO.

BC is not a 'visa' so by applying for citizenship, you are not 'changing or varying their visa category'. BC is different rules and laws to immigration rules.

Dear Forum Members,
I have called home office 6/7 times but no one has given me any satisfying answer to deal with 2 BRPs. I am going to return BRP to return unit. I am sending a copy to Sheffield team who has issues entrepreneur visa. Should i write to anyone else in Home office? How to get refund of fee and health surcharge for my husband? Any help will be much appreciated.
