Had an overstay in my last stay. Would it affect Tier2 ICT?

Post by Life2017 » Tue May 09, 2017 8:20 am

During my last stay in 2012, I had received tier 4 curtailment letter on 24-05-2012. I vaguely remember that the letter was dated around mid april 2012 but i only received in may. After receiving it, I immediately left my part job the very next day. I booked my flight and left the country on 25-07-2012 on my own. I am not sure if i had overstayed and breached any laws. Now after almost 4 and half years, My current firm is filing an Tier 2 ICT visa. Would my past history affect the decision?

There are two questions in Visa application
1) Have you ever been deported or removed, otherwise had to leave Uk in last 10 yrs?
Yes or No

2) Have you ever voluntarily elected to depart UK in last 10 years?
Yes or No

If i answer Yes to first question, It pops up with more fields like country from where i am deported, deportation/removal date, airport, reason for deportation.
I dont think my case falls in this category as it asks for deportation/removal details. i was never deported or removed or had anything of the sort on my passport.

The second question on marking yes, asks for fields Date of departure, airport, Immigration decision and papers you were served, and reference number. I can fill these fields very well.

Any suggestions on how to go with my application? Am I at risk?

What did the curtailment letter say?

If you left the UK voluntarily, then I think that they neither removed nor deported you.

At that time, you may overstay for at most 90 days without any future entry clearance consequences.

What was the curtailment date in the letter? It is usually 60 days from the time letter is sent. From your timeline it is unlikely that you crossed the 60 day limit

I dont remember the day exactly.. It could be somtime around mid april. But the letter reached me on 24 May 2012. Does every curtailment letter have 60 day curtailment period by default?

Do you still have the letter?

In 2012, overstay period was 28 days. So I think it's highly unlikely that you ended up overstaying beyond 60 days curtailment period + 28 days grace period. You can know for sure if you do a SAR with UKVI . It takes a long time though

Are you calculating these days from the day i received the letter or from the day it is dated? In former case, I think i am not an overstayer. But in the later case, I might have an overstay of (60 days curtailment period + 55 days extra ).

Do i need to explain this on a separate letter? I dont want to give any wrong impression of deception to ECO which could tamper the decision.

Any overstay shouldn't affect your current application.

However, as you don't have their letter and memory is imperfect, do explain "as best you can remember".

Had a Uk visa refusal in past. Dont remember exact dates

Post by Life2017 » Tue May 09, 2017 2:14 pm

I had a refusal on Tier 1 PSW dependent visa in the past around aug/sep 2011. Now while filling Tier 2 ICT application, I have encountered a question like "Have you been refused a visa for any country including the UK in the last 10 years?" When I say Yes to this question, It asks for following mandatory details.

Country of Visa Application
Type of visa refused
Date of refusal
Reason for Refusal

What should i put in the date? I didn't keep any records with me.

Appreciate your suggestions.

Thanks
