Not a genuine student Administration review

Post by Mshahan » Sat May 20, 2017 1:14 pm

Hi ,

I have applied for uk tier 4 visa in 4th april 2017
Got my visa refused 11th may 2017 . ( Not satisfied that i am a genuine student on 245zv k )
i applied for an administration review on 16th may 2017.

reasons were : while my bachelor degree in my home country , i was in uk 2011 to 2012 at level 4 program .despite i could not certified by uk educational institute i came back my home country and complete my bachelor course. the eco mention i am a in- consistence student because i applied at lower level course in 2011 and now he feel doubt on my intention. secondly in my my first interview i said i want to get a managerial job like hr manager and gm etc. when i got second ph call from uk home office the eco asked me same question and i have answered same. This is the second reason the eco pointed out that why i did not choose msc instead of mba .

can any one tell me ,is these are the reasons can be refuse or justify a student whether he is a genuine student or not ?

Thank you

Generally it's a loaded question - if you will go down the Admin Review option you need to prove why the initial decision was wrong, not to bring in more facts. Suggest that you further explore why your MSc is relevant to your career now and why your Bachelors was done overseas.

Sah's favorite phrase here - speak to your ISA's. I am aware more ISA's in the sector are challenging these refusals and I can see from this specific refusal that there is merit in an Admin Review (you are overseas, exempt from Academic Progression, therefore the questions should be clarifying your credibility, not study history..)

Many thanks ,

I have already applied for AR myself, its really hurt when i saw the refusal reason the eco made. Basically , i know what was my intention and why i choose .
I was tried to demotivated by others but i think if there is 1 percentages chance to overturn refusal then i should go for . if the decision remain same i would not apply again for any fresh application.
if the home office thought i applied a lower level course they could refused my visa back in 2011 but now when i applied for an upper level of course why now? secondly, MBA and Msc both has similar priority regarding job in Bangladesh job market context so i answered him as i want to be here. My question is that is it wrong to expect a better job after post graduation ?

so i think the way i explained , if the AR manager judge fairly , i should get visa.
the time they take to processing its really harmful to any student , because if i refused by the hm again it could take more than a month to get my tuition fees refund and that will be very late for other country to apply.

Is there anyone can tell me by your own judgment , the following words i have submit in my AR can work or not ?

Visa Refusal reason:- Not satisfy that the applicant is a genuine student .
Why I took lower level diploma
I was struggling with my bachelor degree result, between the year of 2008 to 2010 and for a good outcome of my student life in 2011 I applied for NQF level 4 in UK.
Despite, I could not certified by the UK education institute because of their licenses problem but in Bangladesh the following years result shows how motivated I was in my bachelor degree and it was only for the course I have taken in UK. Inspired by my previous study experience now I have applied for an upper level course.
Another issue of inconsistency in my study. With respect my whole study life I was consists in my specific subject area which is business study and if I could submit my diploma certificate in Bangladesh I could get subject waiver from the university. So in that regard i think the consistency are maintained.
Secondly, the eco was not satisfied why I wants to peruse MBA instead of Msc in HR management.
Mba degree not only help me to get my desirable job also I will able to get the knowledge of business skills where Msc in HR is only specialized in hr management.
Again, the eco also not satisfied because I told him in my second interview that I want to get a better job after completing my mba.
My ultimate goal is to develop my knowledge through education and wants to develop my career in Bangladesh. All I said Hr manager, ceo, general manager etc these are the jobs I can expect with an mba degree and these are the better jobs. In context of Bangladesh job market the mba and msc consider as same degree so I answered according Bangladesh economical point of view.

Take Sah's heeded advice and run that past an International Student Advisor. If you've already applied for the AR then there's little we can do to advise you here or direct you on - any opinions we have are purely discretionary. If you have not submitted your AR then you should really speak to an ISA - your University has contact with the UKVI and can also support your AR if appropriate.

I also realised I referred to MSC in my original post instead of MBA.....
