Likely To Be Rejected FLR-M Renewal After Giving Birth?

Post by iitob » Mon May 22, 2017 9:22 pm

My wife and I were married in the UK just over 2 years ago on a Marriage Visa which was then followed up by a 2 1/2 year Leave To Remain. This will expire in November 2017 and so we are due to apply for the renewal come October 2017. My wife is now 5 months pregnant and we are considering buying a house (already had an offer accepted and mortgage is almost finalised). However, we've been concerned about reading some stories about renewal rejections and the effect they can have. For us, this would possibly mean us having to leave the UK with a 6 week old baby, and having recently purchased a house here.

So I would like to ask if anyone has any knowledge or even an informed opinion of how likely we are to be accepted given the following circumstances.

1. Of the 24 months my wife has had Leave To Remain, we've sent around 15 months outside the UK (mostly living/working in Vietnam, which is where she is from).

2. She did not apply for her National Insurance Number until January 2017. This was said to be very unusual when we had the NIN interview, and something we'd need to explain in our renewal application.

3. Prior to returning to the UK to get married, I'd not lived in the UK for 3 1/2 years previous, and have only spent around 12 months in the UK in the past 5 years.

Our living situation (i.e. not being in the UK much) has been an issue with us getting a mortgage and life insurance in the UK - it seems that it inspires less confidence that you're going to stick around. I have read articles about couples who've been rejected FLR-M due to working overseas during their Leave To Remain, so would appreciate any insight into whether this is likely to be the same for us.

If there is a significant enough risk, we will leave the country to have baby, settle elsewhere for a year or so and then re-apply from overseas. Otherwise we'll continue on with the house purchase and hope that the renewal is accepted.

Thanks for reading, and again, would really appreciate any input :)
