Spouse visa for 36 months!

Post by archie16 » Mon May 29, 2017 10:46 pm

Hi all

I have got a query. My spouse visa is about to expire next month. I went for a same day service for the same in 2014 and was granted a 36 month spouse visa. Th case worker advised that I could apply for ILR after completing 2 years as the spouse. An additional document which was attached to the approval letter also confirmed that “in order to qualify for settlement you must have completed a period of 2 years in the United Kingdom as the spouse.
Please understand any future application that you make in the marriage category will be assessed against paragraphs 284 or 287 or 295D or 295G of the Immigration Rules”.

This was the first time I applied for spouse visa. I got married in 2011(in UK) and since then we have been living together. My Husband is settled (LR) here.

Am I right in using SET(m) form?

The letter appears to be a mistake, as was the period of leave they granted. A spouse entry clearance should have been valid for 33 months. A further leave to remain, FLR(M), should have been valid for 30 months.

You should apply for FLR(M) to complete the required 5 years.

I guess I understand what you are saying but the issue is even the case worker said the same about applying for ILR in 2 years time.

Was this an entry clearance or FLR(M)? It appears to be FLR(M), if it was the same day service?

Did you have leave as a student or a student dependant after marriage in 2011?

Did you have Leave as PSW or PSW dependant in 2013?

What was the date of the spouse leave application in 2014?
