Got ILR recently Tier 2 ICT route - Which form for spouse?

Got ILR recently Tier 2 ICT route - Which form for spouse?

Hi Members,

I got ILR recently (Feb 2017) through Tier 2 ICT route (which got expired last month May 2017). My partner who is in UK with me on his own Tier 2 ICT visa would need to switch to my dependent. I am really confused which form to choose, please could someone advice which form should I choose for ILR in country dependent visa. Many Thanks.

There is no 'ILR dependent' visa. If your husband wants to switch from his own Tier 2 ICT visa he will have to submit a FLR(M) application.

This will reset his immigration clock to zero and he will be on a new 5 year route to settlement (2.5 x 2.5 years), unless he qualifies for ILR under 10 year long residence before then.

In addition to the £933 visa fee (postal application) or £1523 in person premium appointment, he will also have to pay the £500 IHS surcharge and meet the English language requirement.

Many Thanks, Casa. Reason behind confusion is FLR (M) is stating the below Exceptions, where I am falling under below highlighted category (got ILR after serving 5+ years on Tier 2 ICT). Please could you advice if I am misunderstanding something wrong.

Exceptions
You may need to apply in a different way if:

you’re outside the UK
your partner’s from the EEA or Switzerland
your partner originally had a temporary visa as a worker
you’re the victim of domestic violence or your partner has died
you applied for a ‘family of a settled person’ visa before 9 July 2012
you want to reunite with a partner or parent who has asylum or humanitarian protection in the UK

This refers to a partner/spouse who is holding a PBS dependent visa. In your case, according to your opening post your partner has his own Tier 2 ICT visa and wishes to switch to a spouse visa from within the UK.

Edit: I note that you mention 'partner', not 'husband'. Can you clarify your relationship?
