Hello sir/madam
My wifes flrm extension is due in july and there are couple of confisons in my mind, i would greatly appreciate if you can help me on this
1, i am british and my wife gets the child tax credit in her bank account, though it is applied under joint names...is it ok with that?
2, my elder son is not british though he was born in uk and eligible for mn1 registration, and he also got dependant visa expiring in july....now because he was born in uk,so in the last flrm application i didnt show extra income for him....like i showed 18600£...do i need the same now?
is he subject to immigration control? i am about to apply his mn1 registration next week..
we have 2 more kids uk born..
yours thankfuly

1. Fine
2. Yes he is subject to immigration control as he holds a visa and is NOT British yes. Did you state in the last FLR(M) that he would be registered as BC hence only showing the lower level of income? Suggest apply for your spouse after you submit his MN1 so that you can state you have applied for him and why you are only showing the £18,600pa.

The higher level income is NOT required when your children are British. Yours are not British. Just being born in the UK gives no special exemptions unless the child is British.

thank you.
i have checke the childern link( register for british nationalit) for documents required with the application. it says
The only documents required are UK birth certificate and evidence that parent obtained ILR/PR. The application can be made if the child is in the UK or abroad
Now can i send my acceptance letter of british naturalization or a certificate of citizenship? along with the birth certificate of the child.
i do not want to send my passport, and nationality checking servie people are too busy for next 2 months.

You must send your ILR BRP card, assuming you still have this.
Check another NCS. You can apply at ANY of the NCS offices it does not have to be the one at your council.

No they don't. You can apply at ANY one. Many people have done this with some traveling 100's of miles.

HO keep your documents for the whole time they process your application and until a decision is made and you only get them back shortly before or shortly after the approval letter. Some members have waited over a year for a decision

my wife flr(m) is due for extension and expiring on 15 july, and i want to book a window appointment
can i book for 1st of july. if she gets the visa extension, would it be starting from 15 of july ( her current expiry date) or from 1 of july.( that will create a shortfall in her 5 year ilr route)
please advice me whats the right date of apply.

thank you casa
if she gets visa on 1st july for 2.5 years, then wouldn't it create a shortfall for her 5 year route for ilr?
because this extension will finish 15 days earlier than 5 years stay in uk , and again she would need to apply for anther extension before qualify for ilr.
kind regards

She can apply for ILR within 28 days before reaching 5 years residence.

thank you casa for your response.
how many days out of uk are allowed under flrm in 5 years before eligible for ilr? my wife was out for quite a lot.
lastly my wife stayed in uk for 6 months under a spouse visa tier 1 general, before getting flrm, will those 6 months count towards her ilr?
kind regards

Best to declare the absence of 5.9 months as it's very close to 180 days.

Unfortunately no. Perhaps you can find someone to care for him on the day.

Have you received the approval letter and BC registration certificate yet??
If not, the message from passport office is a standard automated message sent to all applicants.
