Urgent!!! EU national cancellation of EEA Family application

Hello all 

I need urgent help. I found out that my partner is using me to get a permit. I have .messages showing he is in love and planning to have children with his supposed ex girlfriend and they are still in a relationship.
I am a E U resident from Denmark living in London. We have done the traditional wedding ( in absentia) as he could not go back to Nigeria with me to do it. We put in the application 5 months ago and no answer yet.
Can i cancel the application and how?

All suggestions needed.

What application did you applied for, RC or PR and are you too married in a court or just the traditional marriage?

Application for him was RC I believe.

As an EEA citizen, if you are legally married in the country in which the ceremony took place (and the marriage is recognised by the UK), your spouse has the legal right to reside in the same country as you, even if s/he is separated from you.

S/he retains that right until the decree absolute of the divorce.

So, even if you withdraw the application, your spouse can reapply and so long as s/he has proof that you are resident and exercising treaty rights in the UK, s/he is entitled to a Residence Card under EU law.

If truly that is what he has done, the simple thing you need to do are as follows.

1, Write to the home office that you will like to withdraw your sponsorship on the application but you need your name and surname, date of birth, nationalty and type of the application including all his own and your address and post it recorded sign for to the address you actually posted the application to in Dunham/Liverpool . Mind you, you may not explain why in the letter because they don't have to know it is your choice.


2, His application case Id number as it is 5 month ago you both submitted he would have been given certificate of application by now which will have the number on it if you can get the letter.

3, That is all you need simple as that and you can re submit it in future if he's honest with you without any trouble. They will send it back possibly in 10 working days.
