Naturalisation application effect on non-EEA family member

Post by imm_applicant2017 » Thu Jun 15, 2017 10:40 am

Hello, I wasn't aware that my non-EEA family member would lose their temporary residence rights when I applied for naturalisation. I sent naturalisation application 3 months ago and now want to avoid the implications of my dual British-EU citizenship for my non-EEA family member, maybe stop application. What would you be the best course of action for me:
1) Withdraw the application and re-apply after my family member gets permanent residence card?
2) Not attend the naturalisation ceremony? (and attend it, if there are improvements in law in summer due to the decision of the European Court of Justice related to Lounes case)
Which way is better for my possible subsequent naturalisation application in the future?
Thanks

How long has your family member been here on a residence card?

Easiest probably is to just not go to the ceremony.

My family member would be able to apply for permanent residence next year.
That what we were inclined to do - not attend the ceremony, but thought it might raise questions later in the Home Office, that a successful applicant fails to show up at the ceremony. And this option would result in refusal letter for the 1st naturalisation application.
We wanted to compare with the option to withdraw - maybe it doesn't result in refusal letter for naturalisation, and the Home Office just stores the 1st application in a file somewhere?

Not attending will have no effect on future applications.
