How many applications for Spouse Visa/Tier 1 can you make?

How many applications for Spouse Visa/Tier 1 can you make?

My husband and I are about to submit a Spouse Visa Application and we are sure it will be denied. Only because of our age difference. We have 3 large files of evidence of a genuine and subsisting relationship. We were married in Morocco in April and were interviewed for 3 hours by Moroccan Police to ensure our relationship is genuine. We have been together over a year. My husband is much younger than me and there is a great deal of prejudice about this at the Home Office. We know that they are looking to find any chink in any person's armour, despite our relationship being one based on love and respect.
Given the likelihood it will be rejected purely on the grounds of age prejudice, we need to know if it is better to re submit or go to Tier 1?
Are you allowed to re submit Spouse Visa applications and Tier 1's after a period of time?

Unless you are referring to Tier 1 Entrepreneur, the Tier 1 General category is no longer open to new applicants.

You can submit a spouse settlement visa application as many times as you like, but as long as you provide compelling evidence to prove your relationship is genuine the visa can't be refused due to an age difference alone.

Thank you Casa, you have given us renewed hope. I was of the opinion that the HO thought all such relationships were sham or bogus and will try to discredit our love for each other by undermining the evidence we have. We have provided photographs, Messenger, Screenshots where we speak via Skype every day. I have visited my husband 6 times, met his family who celebrated our wedding at their home and gathered together receipts for food eaten, accommodation we have stayed in, Boarding passes, baggage passes, tickets and every possible thing we can. We meet the financial criteria and I have a 3 bedroom house just waiting for my husband to join me. Our evidence includes testimonials from friends of mine who confirm I am not a vulnerable woman, being exploited or groomed by someone whose sole aim is to get to the UK and disappear.

Thank you once again. When I mentioned Tier 1, I meant the Tribunal under Human Rights legislation. Article 8. Would be better to re apply if it is rejected or go to Tribunal?

Tier 1 is a visa category not tribunal. You have tribunal, upper tribunal etc.

It depends on the reason for the refusal and what grounds you have to challenge the decision.

Focus on submitting strong evidence, not only regarding your relationship, but also financial, accommodation, English language A1 level from a UKVI approved test provider, valid TB certificate etc. Don't leave the ECO any wriggle room , and think POSITIVE.

Thanks Casa, All done! Accommodation Report, Finances, Accountant's confirmation of earnings, TAA approved accountant, UTR details (I am self employed) confirmation of SA302, Bank Statements, evidence of savings, evidence of relationship, photographs, Skype, Messenger, WhatsApp, IELTS done, TB test done and Police Report done and translated. Marriage Certificate, translated and Apostle Sealed. Phew.... 3 folders full of evidence of all kinds.
Think we have crossed every t and dotted every i and after reading your response, I'm feeling positive again. Thank you....

Hi all. Gibbosl I wish you all the best with your application, I will be in the same position in October when my wife applies from morocco as well. I just want to ask one question concerning the moroccan marriage certificate. I have it translated into English but why is there the need for it to be apostille sealed and if it is necessary how do I go about doing that? Thank you.

You can get an official translator who was recognised by the Court and recommended to us by our Solicitor. We used a Solicitor recognised by the Home Office website in Agadir and he suggested he give an Apostile sealed translation which they have to get stamped at the Local Authority/Court. It just gives more credibility to the translation and it not entirely necessary. You pay a fee of course, but we got everything officially translated and Apostile sealed. Search one out at a translation office. May be your wife could find a local officiated translator and ask them to get the documents Apostile sealed?

Good luck! The prejudice does not seem to spread to older men and younger women, just the other way round. Apparently woman are seen to be more vulnerable and likely to be exploited which is ageist and insulting.

Thank you gibbosl, appreciate your prompt response. I do agree with casa in that I don't think you have anything to worry about. Your case seems strong and you have provided enough evidence. I hope you are successful.

With regards to our marriage certificate it was translated by a government approved translator stamped by them. The translator was recommended on the British embassy website, so im just thinking this whole apostille thing may not be necessary. I just need a police report translated then we'll be good to go.

Thanks MThomas. By the sounds of it you have the Court approved translator so like you say, I don't think it will be necessary. I wish you and your wife well. This process is all consuming and every time I hear of comments raised by the Government regarding immigration, my stomach starts to churn. Be strong and positive. I am sure you will both be fine and I wish you both the very best of success. I can give good advice, but rarely take it myself. I hope you and Casa are right. It has taken a great deal of time, effort and focus to get it this far. But it will be worth it to be with the people we love and cherish.
