Redundancy

Post by dawndetector » Sat Jun 24, 2017 6:33 am

Hi,

In case I am made redundant by the company will that also mean that my Tier 2 ICT Visa will be revoked immediately?
My contract says that my company will have to give me a notice of 1 month for termination, is redundancy = termination?

How long can I stay in the UK from the moment I am terminated?

Thanks.

The issue of your contract, redundancy / termination are HR issues. Usually the company should give you 1 month notice either termination or redundancy according to your contract. However if the company is going through difficult financial problem, they might not give any notice especially is you have worked for less than 2 years with the company.
If you think your job is under threat of redundancy, start looking for another job.

If you are made redundant and the company notifies UKVI, your visa will be curtailed and given 60days to leave the country or change your visa.
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.

The OP cannot switch as currently on Tier 2 ICT for last 2.5 years, current visa expires in December.

Hi, what does OP mean? Do you mind to explain again what do you mean by this:

The OP cannot switch as currently on Tier 2 ICT for last 2.5 years, current visa expires in December.

Thanks!

OP = original poster. In other words, in this case you.

No you cannot because your on Tier 2 ICT visa and NOT on Tier 2 General. You will very likely be subject to the 12 month cooling off period.
